Statement of Claim
Claimant says:
"We brought a truck from JM Auto Sales, the seller assured us that he services all the vehicles and he wants the customers to be happy, he did pointed out that the tire was low and the head gasket needs replacement, that we agreed on, well we took the truck to our mechanic and he told us that the transmission is no good, the center links need replacement, it needs a wheel alignment, and needs an exhaust flange manifold, he asked me to take it to his mechanic in Cedar Lake, I'm thinking we are going to get this fixed, his mechanic gave me a written estimate on the cost for fixing the transmission only, so we drove 120 miles to satisfy him with the fact that the transmission is no good, I called the seller and left him a message, he called me back after 5 pm told me that he only made $250.00 off the sale of the truck and that he would be willing to give me half of the repair for the transmission, that my guy was cheaper ( what about the other repairs ) I told him that I would call him the next day that I was working and that I don't agree with nothing he said. I called him and told him that I want my money back or trade for another truck, he didn't except my offer and told me that he would only pay for half the transmission. To me the truck is unsafe, he wants his customers to be happy, I'm not happy that this issue is not getting fixed."

  • I disagree with this claim, Nancy Gardenas has no merit to make this claim. I never spoke to her, except to her signing all purchase documents. her friend George was the one who did the test drive and made the deal. I also drove the truck several times and did not see any problems with the truck. In her claim she lost work time, when in fact she was not driving the truck, it was put in her name because George had legal problems and could not put the truck in his name. We hava a federal buyers guide signed by both Nancy and George that states the truck is bought as is without a warranty. We are truly sorry that weeks later there were problems with the truck, but when buying a 20 year old truck you never know if they will have problems and we have no idea if the truck was abused or not by the buyer. We have been in business many years and have a good standing with the Better Business Bureau. We believe Nancy should not be making claims that she can not substantiate. Once again we are truly sorry that Nancy or George had problems, but a 20 year old truck can have problems. If you need any additional information , please do not hesiitate to contact us.
