Statement of Claim
Claimant says:
"Sold me an obsolete Techumseh engine for my logsplitter on E-Bay. They did not divulge the info that Techumseh had gone out of buisness on their description. The pull starter shattered into pieces when I went to start it. Contacted them to inform them of the situation about the pull starter and to get them to send me another one. This has been going on since the end of Oct,2012. We were going back and forth for a while, about 3 months, and all of a sudden they stopped contacting me. Have not gotten a replacement part as of yet. I am just trying to have them replace the the part that they say they can not find on the Techumseh engine. If they can not replace the part I think they should take the engine back with full refund plus shipping."

  • I did check with them on the engine replacement. I had made a phone call too them and explained what the engine was for and the shaft was a little to long. I was told that all I had to do was cut the shaft, as I explained in my corespondents with Jack's. I had talked to someone in service. So I was told I could modify it. Also the engine was not listed on E-Bay as a lawnmower engine.

  • I also never refused the starter. I simply mentioned that I don't think I should be getting a used part for a brand new engine. Never said I didn't want it.

The claimant's settlement terms were rejected with the following explanation:
  • I disagree with the explanation / grounds provided

    "Buyer purchased this thru Ebay..it was modified and installed on a device not approved for this engine resulting in damage to the engine..this engine was for a lawnmower and included a safety clutch break. Buyer tryed to start engine without releasing clutch break and damaged the starter..offered replacement used parts but buyer refused. Ebay sided with us, stating in their rules items that are modified can not be returned..we have written statements from the buyer stating he modified the engine and did not check to see if it was an approved replacement for his device. We are a parts supplier we do not offer advice on repair, we provide buyers with parts. If a buyer is unsure of what they need, they should hire a professional"
