Statement of Claim
Claimant says:
"improper contract poor workmanshipthree contracts issued to me . eachcontracrt was for $460..THE CONTRACT STATES THE PRICE MUST BE NO MORE THAN $750.THE THIRD CONTRACT ISSUED WAS GIVEN TO ME AFTER THE JOB WAS FINISHED AND WHICH I HAD NOT SEEN OR SIGNED.I COMPLAINED TO THE OWNER AND PRESIDENT AND HE REFUNDES $180 OF THE $460.THE CAULKING WORK WAS VERT UNPROFESSIONAL AND I PLAN TOHAVE THE WORK REDONE IN ADDITION i CONTACTED PROFESSIONAL IN THE HANDYMAN FIELD AND WAS TOLD THE PRICE IF REPAIRS SHOULD NOT HAQVE EXCEEDED $400.work done may 19,2010 owner contacted in may and 180 refund received in june"

Respondent's Counteroffer Hide
The claimant's settlement terms were rejected with the following explanation:
  • "Mr. Becker,
    When Randy Bode went out to your house you asked him to look and and quote 3 jobs and we provided you pricing of $460 less 92 = $368 for each job. You then agreed to have 2 jobs done immediately and signed contracts for those, and told Randy you were going to hold off on the final job until the next month. no contract was signed for this job. Then when we called to confirm that Randy would be coming out on the 19th we were told you wanted to do the last two jobs on the same day; the second of the two already contracted for and the final job not signed for. Accordingly we told Randy to go ahead and complete the third job. Randy made the mistake of not giving you the third contract for signature when he first arrived. He completed the work on all 3 jobs and asked for and you paid him for those last 2 jobs, having paid for the first job previously.
    You then contacted me and explained what happened and when I confirmed the situation with Randy I sent you two checks totalling $184.00 which is 1/2 of the prce of the third job which Randy did complete. I believe this is a fair compromise for the confusion. With regard to your comments on the quality of the work, you do have a 1 year warranty on the work and, if you call the office we will be happy to come out and re-do the work at no charge if it is not to your liking. If you have the work done by another company that is your decision, it voids our waranty and we will not be responsible for those costs. With regard to the comment that the work should have cost no more than $400.00. I can find you a company that will charge more than we did , and one that will charge less than $400.00. That is why we provide you with pricing up front, before we begin work. It is up to you to decide if you are comfortable with the price before we begin. I regret the confusion and hope that you understand our position. We did the work you requested and will stand behind our work so please contact the office and I will come out wth Randy and we can review and correct the quality issues you have at no charge."
