Statement of Claim
Claimant says:
"My name is Linda & I am a business assistant for Dibrute Investments LLC. Our complaint starts when Fernando received his statement of renewal for a flood insurance policy. The policy had gone up by $300 per year & Fernando was questioning this. As his business assistant, I started in investigating this by doing some research on what flood map zone Fernando's property was actually in.

I found out that when Fernando bought the property in 2013, he was in a flood hazard area that was very low & could choose to have the insurance or not. At that point, I turned to the mortgage company who was requiring the flood policy to close his loan. They sent me a copy of what they had received from Fema as the flood determination zone. This document showed that the property was in a high hazard zone & flood insurance was required.

That was not the same zone as what I had found out. In fact, I found out that the maps had been changed in 2007, 6 years prior to Fernando buying the property, so wondered why the mortgage company had received that erroneous flood zone determination. My next step was to go back to the people who issued the policy to see what zone they had actually issued the policy in. Lo & behold, they had issued the policy in the correct zone.

So when this policy was issued, the mortgage company, the agent of record & the policyholder would have all received a copy. Now, I am wondering who's responsibility was it to go over that policy with Fernando & that was, of course, his agent. That did not happen, the policy was issued, put in is file & life went on. Myself, being an insurance agent for 30 years, would have called Fernando & said "Let's review this policy so you know what you have".

I then go back to the agent of record & ask him if this was done. Well things have changed because the agent who wrote this policy is no longer with them & has moved on. The current agent has been there about 1 year. Okay, so where does that leave us...going back to Flood Pro to have the money refunded for the three years he paid premium when he did not have to.

We have already had two conversations with Flood Pro, conference calls between Fernando, myself & representatives of Flood Pro. They put it back on the agent. Now in Fernando's defense, as an ordinary layperson, he would not have known the difference between a zone AE & a zone X, so he would not have ever known that he did not have to have the insurance.

We believe that Flood Pro should give Fernando the premium back that he paid for the three years he actually did not have to have it. It would not be such a big deal but it adds up to about $1000. Now just to set the record straight, the mortgage company also did not monitor this."
