Statement of Claim
Claimant says:
"On August 3rd, 2010, I met with a Mortgage Loan Officer for First Tennessee Bank reference to re-financing our home at a lower interst rate. We were told that the bank will go through the VA and have a Appraiser come to the home. A person from Bailey and Associates Real Estate Apprisier in Kingsport came to the house and after looking at the house, he file a report stated that my home was a manufacuted home and not a modular home. I received a letter from the bank personnal stated that the appraiser stated that since the home has a red decal, this home is not a modular. The bank would not refinance the mortagae and that I will pay for the appraisal of $500, which the money will be taken out of my checking account at First Tennessee Bank. Knowing that the appraisal was not right, I checked with the business where I purchased my home and they assured me that the home is a modular. I then called State of Tennessee Dept of commerce and housing/Manufactured Housing section and was told to go outside the home to see if I see a red tag/decal on the left front corner of the home. I went outside and found no decal anywhere attached to the house. Inside the home there was a green decal that states,"This modular building unit, etc."
I then went to the dealership where I brought my home and I was shown where the red decal was located. I took several pictures of a home that had the decal and took pictures of the my home at each corner to show no red decal. I took these pictures to First Tennessee Bank in Greeneville and showed them that my home did not have a red tag and that appaiser file a false report to the bank and that I should not have to pay the $500.
After waiting for couple of weeks, I was informed that the bank personal spoke to the person who file the appraisal report and they will stick with the report no matter what the pictures or the information I had to prove that my home was a modular. I requested for the bank personal that I should not have to pay for the Appraiser for filing a wrong report. The appraisal report also show that when the appraiser completed his work, in the design section of there report, it states "modular". I again spoke to Bank personal/Mortage section arguing my information and I was told that they will stick with the report and remove the money from my checking account. The only reason I did not get the finance was because of the report that states that my home had a red decal. I even had a letter from Engineering Manager at Norris Homes and he stated that home was a on frame modular home. This was also sent to the bank/mortgage departmen.
I have the evidence to prove the report was wrong and the appraiser filed a false report, I should not have to pay for the service."
