Statement of Claim
Claimant says:
"They repaired my car from an accident on 3/26/15, and released the car back to me on 4/17/15. I asked them at least "2" times if the car had "frame damage", and they indicated that it did NOT. This was not the truth, and I later found out by a "Auto Loss Appraisal", that it was written in the repair estimate in such a way (that you would need an appraiser) to decipher the estimate. If I had known up front that the car had frame damage, I would have negotiated with GEICO (the insurance company accepting liability for the claim) that they WRITE OFF THE VEHICLE AS A TOTAL LOSS. At first, I thought the car looked repaired, but after driving it for awhile, (and returning to ExoticCar Paintworks) they put the car up on a rack and indicated that they couldn't find anything wrong or not assembled correctly on the car. It seemed very unsafe to drive around in a car that wasn't repaired to "pre-accident" condition. At the time of the accident 3/26/15 my car was worth $30K, and I had to "wholesale" it out at a loss of $11,500.00, plus the cost of the Appraisal of $270.00. I think Exoticar Paintworks is responsible for my loss, and I think they should reimburse me for a total of $11,770.00 at a minimum. Knowing what they knew at the time of need, they should have told GEICO this was a total loss."

  • I looked up frame damage and if the frame was truly damaged, that does seem to be a worry. From Carfax: 

    "Damage to the car’s body is always concerning because it can affect passenger safety if it is involved in another accident.

    In modern unibody vehicles with crumple zones that protect the passenger compartment, this is because once the crumple zones have been damaged they are permanently weakened. If the car crashes, these crumple zones will behave unpredictably, which can also cause the airbags to deploy at the wrong time.

    Underlying structural weaknesses can mean that greater damage is caused to the car in an accident."

    Are you saying that you believe that the company hid the frame damage because they wanted the repair work and Geico overlooked it because they didn't want to write it off? I'm not sure from what you've written. How did you come to decide that there had been frame damage? Was it driving wrong, so then you got an appraisal? What are the qualifications of the appraiser? What did Geico say about it? Have you discussed it with them?
