"On April 12, 2011, Ms. Reese signed an agreement that outlined the scope of work that would be performed by Elite Home Renovation. The agreement also outlined the payment schedule for the complete project. A check was issued by you payable to Elite Home Renovation for an initial deposit of $1000.00, that was to be used toward the purchase of materials and to begin work.
On April 13, 2011, materials were purchased for this project from Lowes Home Centers on 50th and Parkside. I outsourced the work to be performed on this day to a third party who was skilled in spackling and coating. Work began in the dining room that consisted of skim coating four walls and the ceiling. It was requested that the couch, television and personal items be removed from the premises where work was to be performed to avoid any damage, but upon arrival to the job, these items were still not removed from the dining room, so work continued around them.
On April 14th 2011 work continued by the third party that included spackling the ceiling and the remaining walls with three coats of spackle. The exterior wall was not coated due to having significant damage that was covered up by a desk that was not removed. Steve Scace asked Ms. Reese if she could turn on her heat to expedite the drying process in order to stay on schedule, but Ms. Reese refused.
On Friday, April 15, 2011 upon arrival it was noticed that the walls we not dry due to no heat in house. It was decided that the third party would come back on Monday, April 18 to continue work on the walls and ceiling. I would then be there on Tuesday, April 19 to finish the job. I would install the trim and baseboards and this part of the project would be completed by April 19. Work would then commence on the living room.
On Saturday April 16, I spoke with Mrs. Reese about the situation and we both agreed that the change in schedule would result in the project being no more than a day or two behind due to the drying issue with the walls in the dining room.
On Monday, April 18, 2011, I received a call that my worker was unable to continue on the job due to other issues. In the meantime I received two other phone calls:The first was a male who introduced himself as a friend of Mrs. Reese and called from 215-280-3940. I believe that it was Mrs. Reese’s husband. I explained the situation to him and he said he understood. I told him I would be there personally on April 19, 2011 around 9-9:30 am to continue the job.
The second call I received was from a male who identified himself as Mrs. Reese’s nephew and called from 610-931-9471. I explained that the agreement was technically between me and Mrs. Reese and that I did not have to answer his questions. He stated that I took money from her for the job and didn’t perform work. He was very irate and threatened me stating “I don’t know him and I will come and find you.” Never did I state to him or anyone that I would not finish the job; that was never my intention. I reiterated that I would be there on April 19. I realized half way through the conversation that Mrs. Reese was part of this conversation through a three-way connection.
I spoke with Mrs. Reese later in the evening on April 18 and stated to her that it was in my best interest to terminate our agreement and that I could not finish the job due to the threat I received from her nephew on my life. I stated I did not feel safe working on her property and that my rights have been violated. I reported this incident to police and an official report was filed in the 24th Police District, DC# 11-24-029844. She threatened to contact the Better Business Bureau and the Remodeling Networx and make a negative report on my business and to release my business from getting any additional work in the future.
Currently, I still have a ladder and scaffold at her location that I have not picked up.
On Wednesday, 4/20/11, I contacted Ms. Reese and asked if I could pick up my equipment and drop off the balance of her deposit which would be the $1,000 less materials purchased (which were left at her premises) and spackling work performed. She refused. I contact Ms. Reese's friend/husband at 215-280-3940 and asked if I could arrange to pick up my equipment and drop off the money. He said he would not be available until after 5:00 on Thursday, 4/22 and would get back to me to confirm. To date, no one has ever called me back. I have attempted to contact them again on 4/22, two times. I left a message once but no one has ever returned my call.
