Statement of Claim
Claimant says:
"I am a parent of a very talented artist. I ran into Derek Facemyre the owner of Drawn to Art in Eustis, Florida while looking for art supplies. He claimed to be a Disney Artist who was now running an Art supply store. Through a series of events I went from enrolling my daughter into Art classes with him at his store to becoming a supposed business partner. I paid him over $16,000 dollars to improve the infrastructure of the store, order larger qualities of inventory and to gain a scholarship with him approved by Disney for art lessons for my daughter and a professional art kit supposedly used by Disney artists only.
Through several hundereds of texts I have proof and bank receipts of withdrawls and some signatures of his proving that he did in fact receive this money from me....and yet a contract was never drawn up to say that I was now 50% owner of his business. I was dumb and gullible I know, but I am SOOOOO glad that I did not get into bed with him with a contract. He's a con artist all around town (I did not know as I was new in town). I'm glad his creditors are not now knocking on my door! Rather I am now knocking on his demanding my money back in what was a complete fraud!!!! He even sold the inventory he had behind my back to other people screaming at him( for pennies on the dollar to add insult to injury). He could have least given it all to me to try and pay me back for the money I gave him so that my daughter could pursue her career on her own since he was not helping her or fulfilling his end of the bargain with art lessons. According to other people who are now calling me who were duped by him I have the largest at stake in being ripped off by him being into Derek for $16,500.
The few times I watched the shop for him I waited on 7 customers in 1 week...5 of those were complaining and demanding money back because they said they paid him for lessons they never got!! One parent drew a very nasty but I know a legit complaint on his store front windows with a balck permanent marker to try and get in touch with him as Derek kept very irregular odd hours at his shop and was liek trying to nail jello to the wall! I knew then that I was in trouble but by then it was too late I had already given him the money and I sat there like an idiot waiting for him to come back from a "shopping spree" of buying a new cash register, security cameras and etc. for the shop!!! Yes I did a dumb thing giving him all that cash without seeing last years profits ( which he said he never had because he was an expert at writing so much "s---" off that he never owed anything to the IRS). That should have been a red flag I know...but just because someone is ignorant does not make them a criminal taking advantage of someone deliberately is criminal. Derek Facemyre is an artist alright..... a CON ARTIST!!!!! Beware of him do NOT give him ANY MONEY for anything. He has skipped town and is now located in Clarksburg West Virginia I believe trying to open another shop there claiming to be a Disney Artist and offering lessons to people they need to prepay for. Beware of Derek W. Facemyre and also his son Andrew Facemyre as he must know what his dad is up to or else he would not be the front man for Derek trying to hide out there. Derek was located through his son getting a drivers license in West Virginia. If Derek is above board why is he hiding behind his son in making this move? I have several stories to share with you if you want to call me my number is (352) 630-7962...see I'm legit if I am willing to put my real name and phone number out there I have nothing to hide! Derek has plenty to hide!"

  • Derek Facemyre has finally contacted me because he has seen the complaint that I have filed against him online. He was very apologetic over what he did to me over the phone, saying I was a good Christian woman and a good mother to my 4 kids and he should not have done what he did and he is losing all kinds of sleep over it. He then said that if I left the site up there was no way he could get work to pay me back the money he owed me. He asked if I would take it down? In good conscience I cannot because he has lied to me more than multiple times. I and my daughter have lost all faith and trust in him that if I take the site down that he would indeed keep his word and pay us back. There is an angry mob here in 3 towns of Mount Dora, Eustis and Tavarese, Florida, who are trying to throw him in jail for fraud as it only takes 3 complaints to label his behavior "a pattern" according to the authorities. If Derek pays me what he owes me, I can keep him out of jail...otherwise I am afraid I will help throw away the key! I'm not a vindictive person I give too much credit often were none is deserved and I have been more than patient with Derek beyond the patience of Job. But he has screwed with my daughters art career and college future and my money which affects my life and ultimately my kids lives.....not smart at all. Ever see a mother bear when you get between her and her cubs? Pay me Derek someway somehow or you will meet the ultimate Mother with a capital "B" (that's for bear? or bitch? you take your pick) right now you are on the wrong side of both...make it right!!!!

  • Derek Facemyre has been in contact with me by phone and text and has expressed remorse and apologies for "what he did to me". I would appreciate for him to list each infraction one by one to show his sincerity but his apology seems to be a blanket apology that I guess I am to apply to a multitude of sins on my own. This is leaving me wary of any resolution or grasp of responsibilty on Derek's part even though I remain hopeful. I therefore have told him that unless he gives me a down payment in good faith of him paying back what he owes me of almost $19,000 I cannot in good conscience remove or take down this claim on peoplesclaim .com. He says he understands how I do not want to take the sight down until I see some cash but he also says he cant get work to pay me back with it up. I feel bad for the guy I really do...but I feel even worse for me...he's going to have to figure it out since he made this bed..he has to sleep in it. I'm still waiting for that first payment. He said he was trying to figure out how to pay me back and that he couldn't promise how much. That's the closest I've ever gotten to a dollar sign from him so far......I will wait alittle while longer.

  • I do believe this lady because he did the same thing to us. He signed an agreement of partnership. We setup an account which he signed and agreed to. He then withdrew all the money gambled it away and fled the state. We have proof and documentation. He is a crook and a gambling addict. Contact if more info is wanted.

  • I wouldn't worry that you didn't have a written agreement. Verbal agreements are enforceable if you can show there was meeting of the minds and that you made payments based upon a reasonable assumption that you'd receive equity in the business.

  • She says she has all the documentation including texts and bank payments etc. If you feel she's lying, would you agree to pay her back any amount that she can prove she paid for equity into your business, or for other promised services? If you'd agree to that, it would show good faith and convince me of your side. If you don't agree to that, then, well, talk's cheap....

    I would agree to act as a mediator in this matter and to examine any documentation relating to proving or disproving this claim

  • The Lucky Artist has NO ties, NEVER will in any form or fashion to this company "Drawn To Art LLC" or to this lady Sharon making these false accusations. Drawn To Art LLC is a company that has been closed due to poor management and handling by the owner Derek (myself), divorce, life falling apart, and moving twice to get my life together. Drawn To Art was an LLC company and if money was owed to this lady as she stated should have taken it to civil court before the time frame that has passed of two (2) years with no documentation to backup any of these claims, otherwise she would have by now. Nothing is owed to this disgruntled and psycho lady that has followed and slandered my personal life, my wive's life, and our families, to the point it shows exactly what i'm saying. As far as the customers and the crazy "tree lady" (which is being dealt with legally) that contacted this nightmare which posts her number to slander the accused at any chance she gets with anybody with a complaint. For those people who were customers of the closed company "Drawn To Art LLC" that might have lost lessons or invested time and money towards stated to better themselves during a difficult time in my life I apologize to you for whatever I have wronged you. For the customers and students of The Lucky Artist I invite you in to ask any questions surrounding these false accusations from this person at any time. As to the "group" that has no life but to sit around, contact people like this, and drink and bash other people because you have no life...take a long look in the mirror and realize that you need help. The Lucky Artist has represented itself well to many happy students. There are always going to be those "customers or students" that can't be made happy.
