Statement of Claim
Claimant says:
"I was sold a 2007 Chevy 2500 truck from Delabruere's Auto shop located in Derby, Vermont in February, 2017. I was told the truck had new tires by the salesman, Ryan Brewster. I also brought the truck back within a week to fix a problem with the steering. I heard a clunking noise and they pulled it in the shop and "fixed" it in fifteen minutes. Within a month the problem returned and my mechanic told me it was a bolt that needed to be replaced which cost over $400. He said it could be greases to do a temporary fix which is what I believe Delabruer's did that day.
However, the real problem is that I was hauling two horses with my daughter to youth world championships in Perry, Georgia two weeks ago. We had a blow out on i 81 in Virginia. The front right tire exploded and I was barely able to maintain control of the truck and trailor. My daughter was hysterical in fear we were going to die. Apparently, the "new" tires were retread tires. The roadside service said this type of tire was illegal in many states including Virginia. We were stuck on the side of the highway from 7pm Sunday evening until noon on Monday. It took three days to fix just the mechanical problems in Virginia.
Upon returning to Vermont I contacted Eric, Sales Manager, and Ryan Brewster, Salesman that sold me this truck about the situation. I asked to be reimbursed for the tire replacement and out of pocket expense. A grand total of $!650. The total job cost almost $4000. which my insurance is paying. These men feel they did nothing wrong because its not illegal to sell retread tires. Even if that is that case it is illegal to commit fraud and tell me they are new tires. And also the steering "fix". At this point I dont even feel comfortable talking with these men because they are confrontational with me. Me and my daughter are lucky to be alive as well as anyone else that might have been involved if I lost control of the truck and trailor. "

The claimant's settlement terms were rejected with the following explanation:
  • I disagree with the explanation / grounds provided

    "First of all, retread tires are not illegal in Vermont. Customer bought the truck with 84556 miles and was told that the truck had newer tires which had been installed by the previous owner. Customer was never told that we had put new tires on the truck. Customers tire issue happened at 101527 miles and approx 6 months after the sale. Customer had put about 17000 miles on the tires and many things might have happened to the tires in the meantime. Who knows if the customer ran over something in the roadway to cause the flat or if maybe the tire pressures weren't where they should have been? It was definitely in no way Delabruere's Auto Sales fault that the tire failed. I checked out the TreadWright tire website and found that the tires are rated for towing, and have a 2 year workmanship warranty and I made the customer aware of that, and that maybe she should call them to see if there is anything that they may be able to do for her, because I believe that the tires are less than 2 yrs. old. The customer had a blowout on the interstate, which is unfortunate, but it was in no way our fault. "
