Statement of Claim
Claimant says:
"Zoar Lutheran Church of Elmwood Park, IL signed a contract and gave Eric Nelson a check for $3,642 on August 11, 2012, for materials to reconstruct a brick sign. He continues to lie to Pastor Guymon. First I should say that he had a good rating with Angies List and that is why he was hired. Angies List will not to anything to help Zoar receive at least some of the money so another contractor can be hired. Eric never got the permits until Dec. His contract was for the materials and to this date he has only put the slab and one column. Pastor has tried calling him and he continues to lie. lie. lie. It is very upsetting to the congregations that any person would lie so much and take our money."

  • Mr. Nelson called two days ago and to me to have my wife stop posting comments about him on the internest. I also gave him the person to call at Zoar about the sign he was contracted in August to reconstruct and it is not nearly half completed. At Christmas time Mr. Nelson told me the sign had come in back had to be sent back before the transformer was bad. Now here it is almost a month and half he tells Zoar Representative that it will be here in two weeks. This is an example of his lies. I found it unforgiveable that he would lie like this to a church. Does he have a conscience?

  • Feb 08, 2013, Construction Logistics, Inc. (responding party) added:
  • there is no claim here, Because pastor guymon is no longer with the church. And to begin with there was no money payed out of his pocket it is an insurance claim. So the dollar amount he is claiming is a lie, and he is a man of the cloth. the only thing I am guilty of is vary poor planing because I over booked a lot of jobs at the same time. I spoke to the new person the now running the church and we and finishing the sign. so Mr guymon stop with the lies on your end because the money that you gave our company is not your money its from the churches insurance co. So if you dont stop this I will sue you for slander in a cook county court my lawyer will be looking at this matter today.

  • Feb 11, 2013, Claiming party added:
  • You can see Mr. Nelson work at Zoar Luther Church, 2940 N 75th Ct Elmwood Park, Il. Contact was signed Aug 11, 2012. This was suppose to be a 4 day job. It is now February 11, 2013. You be the judge.

  • Feb 11, 2013, Construction Logistics, Inc. (responding party) added:
  • Mr. Guymon, I just want to start by saying I have already formally apologized to you because this job was delayed not only because I over-booked other jobs at the same time I scheduled your job, but because of weather and a faulty electrical sign being delivered to my shop for this project. Since your retirement as pastor nobody has contacted me from the church. I received an e-mail from you wife stating that you were going to retire. She demanded I have the sign completed before your last day. Unfortunately, the request came during sub-zero weather. Anyone with common sense knows that masonry work is very difficult to complete in such weather. I spoke to you 3 days ago via phone and asked you for a new contact person for Zoar Church. You told me to contact Mr. Johnston, as he would be handling the completion of this sign(contract). I spoke with Mr. Johnston, explaining that it must be over 30 degrees to complete the masonry portion of the sign. The past week has been rain and frigid temperatures. Tomorrow (2-12-13) I will contact Mr. Johnston again and let him know we will be renting a warm hut to aid in our completion of the sign. A majority of the material is already at the church. The remaining material is being picked up tomorrow. The warm hut will be available next week. The new electrical sign will be delivered the week of 2-24-13. All this information will be conveyed to Mr. Johnston tomorrow. With this information I have provided, I hope the constant bashing of my company By you and your wife will stop. The contract was signed for Zoar Church, and not for you personally. Since you are now enjoying your retirement, you actually have no legal responsibility or authority regarding this contract. Again I apologize I over-booked work. I will continue to work with Mr. Johnston through completion of the project.

  • Feb 12, 2013, Claiming party added:
  • Eric Nelson- your post will be posted at Zoar Lutheran Church where we are still members.

  • Feb 14, 2013, Claiming party added:
  • Eric nelson did respond to me. He did contact Mr. Johnston also, but due to the fact that Mr. Nelson has consistently lied to us since he signed the contract on 8/11/2012 and we, Zoar Lutheran Church gave him a check $3642.50 to purchase materials, we have to take this latest reponse with a grain of salt. The congregation has certainly been informed of all my conversations with Mr. Nelson, so now they just roll their eyes. There is not much faith in Mr. Nelson's words. But by the Grace of God, perhaps Mr. Nelson wil keep his word this time. We do pray that Mr. Nelson will keep his words this time. Members of the Church and even the neighbors around the church are anxiously waiting this sign to be completed. Mr. Nelson mentioned the weather - well, there has been so many nice days that this original 4 day job could have been completed. Therefore, we are giving Mr. Nelson to the end of February to complete this job.

  • I also have been taken for $3,750 on a downpayment for my roof. No work...zero...has been done. He blamed the weather, his health, his busy season, etc. After a year, I realized...he is not going to do the work. I had to get someone else to do the job, because I had a leak in my roof. He keeps saying he will give me my money...but has not!

  • In this situation, because there seems to be a lot of communication between the parties going on, perhaps agreeing to mediation in person with a neutral third party can help everyone find some resolution in this matter. Because of some of the allegations made by both parties here, this case could benefit from having another person take a look at the information, and help the parties to reach a resolution that they can be satisfied with. This, of course, is if for some reason this repair work is not completed as suggested there may be an agreement on in one of the comments above.
