Statement of Claim
Claimant says:
"On the tail end of a long hot drive from California to Montana, I stopped to check out two vehicles at Coeur d'Alene Wheels (in Post Falls?) that were posted on Craigslist. Though terribly hot & exhausted, it seemed like the salesman was being honest with me & would provide good customer service. Apparently I was deliriously wrong!!
When comparing the two vehicles, Dave said the one had not been mechanically checked out yet, but assured me I would not need to make any major repairs within the next few months to the vehicle he eventually sold me ~ because their mechanics had thoroughly checked it out & made all necessary repairs (that point was advertised!) He flippantly mentioned that someone did a poor job of patching up something on one side, but failed to say that the car was involved in 2 major collisions, or that it was purchased at an auction. I wasn't able to see the unmatched paint job covering the passenger door and rear quarter panel until I had bought & washed it! (He handed me the carfax info along with the signed papers.) After paying full retail price ~because they claimed to have a lot invested in repairs ~ I called them days in advance & also twice on the day we were driving from Montana to pick it up, hoping it would be serviced, cleaned & ready to drive home. We arrived late afternoon, only to wait for paperwork to be hastily & sloppily filled out... and then was shocked to find the car parked way out in left field, filthy inside & out!  Even though it hadn't rained since I test-drove it, there were muddy tracks on both the front and back floorboards, which made it look like a party had taken it mud-bogging over the weekend! (I had given Dave deposit money & then overnited a cashier's check the next day.)
Assuming all was good under the hood (thoroughly checked out, right?) I washed the exterior, put gas in it & drove it back to MT.  It was immediately apparent the advertised "turbo" was not functioning & it started clunking on the first mountain pass! I later found the radiator fluid virtually empty, and both engine and transmission fluids were filthy! Plus, it cost $150 to make a 2nd key! Then, within days, the vehicle is inoperable because the power steering pump went out- because of a major leak in the upper line! Had the mechanics actually done their job, instead of a sloppy patch-up job, they would have seen the oil dripping onto the belt. The car was dead in the driveway for over a month before someone found the problem, determining it was negligence that ran the fluid out and burned out the power steering pump.  Someone replaced the fluid but didn't repair the hole in the upper hose line. When I called Dave to tell him that I had not been able to drive the car since returning to Montana, he said that they would try to figure out what the problem might be & get back to me. Then, after telling him it was the power steering pump, he said they would do what they could to help me out. He did call Spalding's to order the part, but (even though it was a relatively inexpensive fix for them to make things right) Dave apparently had no intention of paying for the part or sending it to me.  Over a 10-day period, Spalding's and CDA Wheels never once returned any of my calls  inquiring about the pump & hoses. Totally irritated with incredibly poor customer service, I eventually ordered and paid for the part on my own and hope to eventually find an economically-priced mechanic to install it, after nearly 2 months of inactivity! :/
I am totally digusted with this company who pretended to be all about customer service; they left me hanging as if I deserved this for buying one of their shitty cars without having another mechanic check it out first! (I normally do tons of research on a vehicle before I purchase it, but I trusted Dave... :/  I realize this is my fault as a woman for believing a used car salesman might be honest and considerate, but this fiasco has gone below and beyond common courtesy.  Dave indicated they would make it right but they have done Nothing to make it right!

"I buy and sell cars Im going to state a good car lot would bu a power steering pump and hose and send it to her if she was willing to pay for the labor. Cause apparently this hose has been leaking for sometimes and the car salesman knew of it and knew the car had a few issues. I believe you should reimburse her the amount of the car or the hose and pump"

The claimant's settlement terms were rejected with the following explanation:

    "The vehicle was delivered to Ms. Bishop in good working order. She was never under any pressure to buy it. The work we did to the vehicle was per specifications and completed professionally. This was a used vehicle with parts that wear out and malfunction. Even new vehicles have that trait and that is why there are new vehicle mechanics. Dave did find her the least expensive power steering pump possible and arranged for it to be shipped if she would only pay for it. And we would be happy to work on that car at our discounted shop rate of $55 per hour for anything she would like to have done to it. She also claims that the vehicle is missing the turbo for some reason. I don't believe Mazda made a non-turbo version of this vehicle in 2007 so I am pretty sure she is mistaken. In any case, she bought a vehicle in good working order at a price we agreed on and purchased it, like all used cars, as-is. We both entered into that sale with the knowledge we had of the vehicle at that moment. If something breaks or fails after it is driven a few hundred miles, we can't control that. We do work with all of our customers to try to take care of those kinds of unfortunate occurrences in the best way possible and at the least expense and inconvenience for the customer. Ms. Bishop doesn't live where it is easy for her to come to us for repairs so unfortunately she is working with mechanics in her area. Hopefully she finds one who will take care of her concerns. She has made claims of "clunking" turbo, "virtually empty" fluids. and filthy fluids. We did not claim to have changed the transmission fluid or any other fluid. We did do work on the engine that would have resulted in addition of, or replacement of both engine oil and coolant and sometimes there can be an air bubble in coolant systems that will result in the need to add some coolant after it is driven awhile. She also mentions negligence as the cause of the power steering pump failing. I would agree but it is the responsibility of a vehicle owner (her in this case) to check fluids and insure that they are full. Especially important when you purchase a used vehicle and especially important to do daily for a few days after you first get a vehicle home. So any negligence would be hers to own. We do not change power steering fluid and really nobody does. It's not a normal repair or maintenance item. If it leaks, you refill it. If it leaks a lot, you fix the leak. I will close with this: Ms Bishop purchased a used car at a good price. Repairs are part of the costs of vehicle ownership. Ms Bishop can choose to make repairs on her vehicle or not. But it is unlikely that she will get anyone other than her to pay for those repairs. "
