Statement of Claim
Claimant says:
"I brought in 2 silk dresses and a silk blouse to be dry cleaned. When I went to wear it, I found the blouse to have damages on the back, and then I had a suspicion, so I looked at the silk dresses, and they have more damages than the blouse. I took it back to the dry cleaner, and spoke with the owner. He told me that he hired an independent plant to do his dry cleanings and he have to check with them. He then call me back today, stating the people he hired to clean for him, stated that I could be damaging the dress myself with a belt. I told him that that dress doesn't have a belt and I don't wear a belt with it. So, he tries to blame it on me, and said that they would not do anything for him, and all he can do is repay 10x the amount that I paid for the cleaners. He also told me, the last time that I was there, that because this is a discounted cleaners, I should expected some risk or liability, taking my clothes here. I told him that it doesn't matter if he charged me $2.99 or $10, for the dry cleaning, I don't expected this type of damages on my clothes. If I knew that, then I rather not use his cleaners. I told him today, that I would let everything go, if he put up a sign in his store, stating" that this is a discounted cleaners, and cleans your clothes at your own risk, we are not responsible for any damages!" But he told me that I should not tell him how to handle his business. I said ok, and told him that I will pick up my clothings soon, and we will see about this matter."

  • The damages on these dresses and blouse is not the normal wears and tears, like you said. It actually damages done by someone mishandling the clothes. I just bought these clothing in Jan and Feb of this year, how can it wears and tears like this? I know that we are all not perfect, but when we make mistake, we need to admit it, and accept the fact that someone, whether it's you, your employee, or an independent plant that you personally hired, did something to damage these clothings. You are the owner, so ultimately, you should be responsible for the service that you provided to your customers. It's easy for you to blame it on normal wears and tears, but when you look at the clothing articles, it's very clear that this was done by a human. I already told you, I can let this problem go away, if you put up a sign to inform your customers, like the way you told me " that this is a discounted dry cleaners, so bring your clothes here at your own risk!" If you dare to tell your customers that, then I can forgive you and your mistake. Just keep in mind, you can save yourself some headaches and money, by making the smart decision as a business person. One bad mistake, can cost you more than if you were to resolve it. Maybe, taking a business management class, may help your egoism.

The claimant's settlement terms were rejected with the following explanation:

    "Mrs. Nguyen brought in 3 used silk garments that already had signs of wear and tear befor cleaning. Many people bring in clothes that are damaged before we start our cleaning process. Our sign board clearly states in large bold print "please understand company policy and conditions before cleaning" and also explains on the back of each customer receipts states "we utilize the utmost care in processing articles entrusted to us and use processes which, in our opinion, are best suited to the nature of condition of each individual article. Nonetheless, we cannot assume responsiblity for inherent weakness or defects in materials that are not readily apparent prior to processing. This applies particularly, but not exclusively, to articles made in suede, SILK, satin, double-faced fabrics, vinyl and polyurethane" Also states in the event that we lose or damaged clothing "The companys liability with respect to any lost or damaged article shall not exceed 10 times our charge for processing it" Mrs. Nguyen paid $2.99 per piece. We had a check for $90 but she refused. I was very understanding to her situation and was very polite and never raised my voice and told her i can understand her frustration but these are our policies. She was very irrate and told me she would get her attorney involved. Its very hard to replace used clothing that definitly had alot of wear and tear at full value for what she is asking. "
