Statement of Claim
Claimant says:
"I would never have noticed that they tried to charge my card after I had already canceled automatic payments if my card number hadn't changed because of a capital one security issue. Note that recurring payments were canceled on the 22nd and they attempted to charge my card on the 23rd. Before I canceled recurring payments I had updated the account with my new card number. Since I canceled before the new card could be charged they went ahead and charged the old card that they had on file. They had no right to charge any card and should have (if they followed proper business practices) sent me a bill for the balance. They instead charged my card illegally, and when they found it was no longer valid, charged me a $25 "Returned Payment Fee". I called to have the fee reversed and they told me that capital one had charged them the fee so they "had to" pass it on to me. Frustrated as I was, I paid the balance and went about my day. 

I later found the email that proved that I had canceled recurring payments on the 22nd, and called back Time Warner to tell them about the email. I was put on hold for ten minutes and when the representative came back, she told me that Time Warner would cut me a check for $25 but I would have to pick it up at the local store. 

I am posting this because I am sick of these TBTF corporations thinking that they can systematically rob innocent individuals. Please share so that these types of companies may be held accountable for their grievous actions against humanity.

Bottom line - Time Warner illegally charged a card they had on file. This was not a computer glitch. This was a person who made a decision that was wrong. Computers do not make these sort of mistakes, only people do...

BTW recurring payments were set up to come out on the 25th of every month. Never once did a recurring payment come out on the 23rd except for this one, which was not authorized. The only other exception to this was the 25th of December which was Christmas. The payment in that case came out the next day on the 26th.

I have already contacted them and I believe that they are in the process of refunding my $25. I just want this to never happen again to anybody. I can't even imagine how many people they have done this to already."
