Statement of Claim
Claimant says:
"This is a copy of an email I sent to Chaplin Motorsports on Sept 5, 2011. It summarizes my complaint to them: I purchased a New Fox Racing Empire Chest Protector from you on June 4th. I contacted you concerning a refund/exchange. You advised me to return it with original tags. I did this. I contacted you through ebay email on June 12th, July 22, and August 2 inquiring on the status of refund. I received no response. I located your phone number and called. Initially I was told that the item was never returned. I called again with tracking # of 1Z89X7200370588921 and confirmation that "Labriola" had signed for it. I was then told it was received and someone would be contacting me the next morning to arrange for refund. It's been another month and I have not received a refund or heard from anyone at Chaplin motorsports. Having waited 3 months and the season gone by, I would appreciate a full refund as soon as possible. I did not leave negative feedback because I trusted that you would follow through by doing as promised in a reasonable amount of time. I hope I was not wrong.

Again, I received no response from Chaplin motorsports. I then contacted the Connecticut Better Business Bureau and filed a complaint. They forwarded my complaint to Chaplin Motorsports and requested a response from them within two weeks. Chaplin Kawasaki DID NOT RESPOND. After a follow-up request, they DID NOT RESPOND.

As of this date, they have not responded to any of my emails or requests for the refund I am entitled to. They ignored the Ct. Better Business Bureau, and they continue to sell on ebay. Ebay could not assist because I waited too long to file a complaint. I waited as long as I did because Chaplin Kawasaki "strung me along" and made me believe they were a business with a bit of integrity and would eventually honor their promise to reimburse me. I honored my promise to promptly return the merchandise that was not the right size. They ended up with the item and it cost me roughly $100.00 not including my time and frustration."
