Statement of Claim
Claimant says:
"5 Months after i purchased the vehicle i began having problems with the rear of the car shaking and making a noise. Car-Mart sent the vehicle to their garage (Harlan's automotive). According to Car-Mart there was nothing wrong with the vehicle, so i spoke with the mechanic myself and he told me that the Torque Converter was going out in the vehicle. The vehicle would not turn a corner properly it would start to turn then the rear of the vehicle would slide the rest of the way around. My father checked the rear differential and found black sludge in it ,he cleaned out as much as possible and put 90 weight oil in the differential. That did not help the sliding. then the heater in the middle of winter quit heating and the car started overheating. Placed new antifreeze ,did not help. Car continued to over heat, and all of a sudden antifreeze starting pouring out from motor. I Took the car to my mechanic he replaced a valve and checked the radiator which he found a substance of sand and clay in it. We flushed the radiator and placed more antifreeze , on our 4th gallon of antifreeze at this point. Did not help kept overheating my mechanic at this point said it probably had more problems expensive ones I needed to decide what to do. Adding another gallon of antifreeze.
I am a single mother of 2 I had lost my job only had one income. My parents tried to help by making a couple of payments for me. I spoke with Car-Mart a few more times telling them the vehicle was continuing to have problems they seemed unconcerned. I then decided I could not afford the vehicle repairs and payments also. I previously had problems making the payments they offered for me to sign a release giving the vehicle back to them. I opted at that point to try and continue to make the payments. Now that my mechanic has found all these problems and I returned the vehicle to their lot on approximately 2/7/13. I called the next day they told me the manager would not be back till the next day I called the next day and they said he still was not back.
Then I started receiving letter from them daily and they were adding almost $100 a day to the cost. My mother then spoke with Alisha Besaw on several occasions with her promising to get right back with us which she never did, always making excuses why she didn't. Now I receive a letter stating they are going to take it to a private auction and if they didn't get full price I would have to pay the difference.
With the mechanical problems it has there is no way they can get full amount for the vehicle and I still am not working I would like to just sign a lease and be done with it. Please help me with this problem."
