Statement of Claim

COMPLAINT: Unacceptable porcelain tile installation, damage to property. 
Summary: Bela Vista Contractors Inc., a professional tile installation company, was contracted to install (dark brown) porcelain tiles over a majority of the first floor of our newly constructed home.
The grout between the tiles was to be a "dark chocolate brown" (MAPEI Ultracolor Plus FA Chocolate lot number reported was J30D647), to match the tiles.
Following installation, there was a permanent grey haze over a majority of the tiles, the grout between the tiles was a "discolored" grey color (NOT the contracted Chocolate brown).
MAPEI concludes that the issue reported could not be attributed to a MAPEI product deficiency.
MAPEI has concluded, possible causes for the conditions experienced for this project can be attributed to one or more, but not limited to, the following:
· Contaminated with gypsum dust from drywall, plaster, dirt or dust from construction activity.
· Insufficient curing time allowed for setting material or substrate before grouting.
· Excessive use of water used during the mixing, application and cleaning process.
· The concentration of cleaning chemicals may be too strong, used too early, used on dry joints and/or not rinsed properly after use.

Also, following the installation, there was extensive damage to our property as a result of pure carelessness and negligence.
The resulting tile installation was of such poor quality, I am going to have to "jack-hammer" the current tiles and replace. This will create substantial additional costs due to re-tiling, dislocation, etc.

Poor workmanship and careless installation of tiles and grout:
Scratched Carrera Marble counter top by placing toilet bowl cover directly on marble. Was repaired.
2)    Left large amounts of grout and/or thinset on bottom base of white kitchen and bathroom cabinets.  Not cleaned, Poor workmanship
3)    Toilet was installed crooked and was not fixed. Permanent Damage
 4)    Ruined the bottom of our newly installed stainless steel stove with excessive brown water or solution during the cleaning of floors.  Maricano of Bela Vista buffed the bottom with Brasso and now it has permanent damage due to buffing.  Permanent damage 5)    After completion of installation of our wood-like floors there was an excessive amount of grout residue on the tiles and the floors looked terrible. We were extremely disappointed and expressed our dissatisfaction. Bela Vista had to come back to clean the floors and after cleaning we noticed a gray haze on the tile and the grout was not a rich dark chocolate brown. I had to request that they come back to clean again with grout haze remover, which did not change the appearance of the grout. Permanent Damage 6)    Bela Vista cleaned the floor three times and they just shrugged their shoulders as to why the grout was grayed.  Permanent Damage 7)    Mapei report indicates the grout may not have been mixed properly prior to applying to floor or during the cleaning process they use too much water. Permanent Damage 8)    Took 3 bags of extra thin-set to return and never received credit. 9)    There are places where there’s no grout at all in between tiles. Permanent Damage The first time they cleaned the floor I was told they used water.  The cleaning removed the dust from the floors although they still didn’t look right. After that cleaning I noticed that the bottom of my brand new stove was marred with splatter of brown water or some type of solution.  They had to have Marciano come in and buff the bottom drawer with Brasso to remove all the marks left over from the cleaning. I can see permanent buffing marks on the bottom of the stove.

  • WritRespectfully, the June, 22 response to my claim from Bela Vista Contractors Inc.("BVC"), is both unreasonable, and absurd.

    In its response, BVC has deflected all responsibilty and has also made several incorrect (fallacious) statements.

    (1) the unacceptable outcome of the tile installation, as reported by a formal Mapei Industry report was NOT due to the materials, but in the mixing of the materials by BVC installers.

    (2) The home where the tile was installed was not remodeled. It is a brand new home construction. If other contractors working at the home presented a problem, BVC should have identified it as such, and/or deferred their work until a more suitable time.

    (3) BVC has stated that owner (me) accepted the final tile installation outcome. This is far from a true statement.

    Following the final installation process, both my wife and I, pointed out the grey "haze" that prevailed over a majority of the tiles. Additionally, the installed grout color, was not the "chocolate" color as contracted.

    We complained vociferously about the unacceptable outcome of the tile installation, and in an attempt to ameliorate our concerns, BVC arranged for several "professional cleanings" of the tiled floor following the installion.

    There was no effect or difference to the tile "haze" or grout color following the cleanings.

    My wife and I are so upset by the outcome of the tile installation that we are going to "rip-up" the current floor and replace it.

    To that end, I am seeking suitable compensation from BVC for an unacceptable work product, and for damages incurred to our property by BVC workers during the installation.

  • "Our company was hired to do installation only. All material was provided by the owner. Tile, thin set, grout. Customer was remodeling the property at the time of installation with other tradesman on site. Upon completion of work, job was inspected by owner and accepted without any craftsmanship flaw. Quality of material purchased by owner is not our responsibility. "
