Statement of Claim
Claimant says:
"My name is steve hair, I purchased a brand new whirlpool washer at the badcock here in barnwell s.c on january 1st of 2012 store #652. I paid it off august 3rd 2012. I also bought the extended 4 year warrenty, the washer has not worked right from day 1. I called the first week of july 2012. I asked them could I bring it back and get a loaner till mine got fixed, they said no that they had their own repair service contractor. I called the # they had given me, it took me a week to get ahold of them. In the end I had to go with their other contractor which is steves appliance out of bamburg, he was fantastic. But in the mean time I was without a washer machine for 6 weeks, and had to go to the laundromat four times, it cost me forty five dollars each time I went, we live off a set income, my husbands disability. I want to be reimbursed for the times I had to go to the laundromat which comes up to 180.00. We were never late on a payment and paid it off 7 months after we purchased the washer. It has put us in a financial bind . All they do is give me a run around. I have read the contract and it states that they should have brought me a washer until mine got fixed, which they did not do. They stated they don't do that. I need help in getting my money back for the inconvience badcock has put us through not to mention the out of pocket money"

The claimant's settlement terms were rejected with the following explanation:
  • "September 12, 2012

    To whom this may concern:

    This letter is in response to a complaint that we have received from your organization regarding the Badcock Home Furniture & more in Barnwell, South Carolina.

    After researching this matter, we are providing the following response: The Barnwell location did not have a loaner washer to provide to Mr. Hair until his washer was repaired. A servicer was sent to the customer’s home and made repairs to the washer under the manufacturer’s warranty. When Steve’s Appliance left on September 6, 2012 the washer was in working order. The customer contacted the store and informed them the washer had stopped working once again. Customer was told to contact Steve’s Appliance and have them reassess the washer for further issues. After speaking with Steve’s Appliance, the lower harness had a short in the wiring and will be replaced by September 14, 2012. The manufacturer’s warranty does not cover laundry reimbursement and neither does the extended warranty company. Unfortunately we will not be able to provide the reimbursement for Mr. Hair.
    On behalf of the W.S. Badcock Corporation, we apologize for any inconvenience to Mr. Hair, and we consider this matter resolved. We appreciate his business and are available to answer any other questions he may have.
