Statement of Claim
Claimant says:
"

I brought a Toyota Highlander at Auto land on Feb.27, 2013 for $14,200. I gave $8000 as a down payment. They were agreed that the balance of $ 6200 can be finance at a rate of 11.99% for 72 months.
It was a Wednesday evening, after a day of work. I didn’t really paying attention. I was just signed and took the car home.
Next day, my wife took the car for inspection, it couldn’t even pass the New York States inspection and that raised a flag. I took the car to a Toyota repair shop and they found that the needed some serious repairs. I sent an e-mail to the dealer and let them know what happened and I also told them that I’m bringing the car back to choose another one, they were agreed.
Then I look at the contract and I was I shocked. The $14,200 at 11.99% for 72 months became $35,177.12. The $ 6,200 that was supposed to be financed became $ 19,216.58 not include my $8,000 down payment.
Now I’m back. They said okay, chose another car, I did. I picked a more recent car with lower mileage this time. They said, oh! No. We cannot give you this car at a rate of 11.99%. The only rate the bank will be approving for a car like this is a rate of 24%. They refused to give me another car at the same rate. They added, the only thing we can do for you is to take a rental car and leave yours for repairs and come back in three days, and I did.
I called the bank to justify this, the bank said talk to the dealer. I asked the dealer to explain it to me, they said talk to the bank. Meanwhile, I’m stacked with a 7 years old car with 59410 mileages for $35,177.12. Is there any way that matter can be solved and straighten out to get me some of my money back? Thank you in advance

  • I remembered when my wife and I went to see Mr. Maffucci Jr., the Sales Manager in his office trying to fix this. He just walked out on us and said: “If you refused to leave, I’m going to call the police”. My wife and I said great, may be they will find a way to help us out here. We did not leave and he did not call the police either.
    Sometimes, it is very easy to forget about those who did good deeds than to remember those who did bad things to us. It is natural as human being.
    After that, came a very nice middle age gentleman. We were right by the main front office now. He said: “We don’t need to call cops, here is what we are going to do: Give them a rental car! Meanwhile, take the other car to the shop and find out what is wrong with it and else needed to be done”. I don’t even know his name. But we were all agreed and my wife and I had taken this rental car for three days. In two days, we were back and took the other car in question.
    Once again, we have tried three times to resolve this with you privately without involving any friends, relatives and the media. Obviously, we all come to realize and can clearly seeing that talking is not working here and leaving us with no other alternatives.
    Thank you for your prompt attention to this matter.

  • Since my wife and I have been down there three times already trying to find somebody to talk to regarding this matter. 1st, we were trying to get another more recent car, (2010 Highlander) and Mr. Rafic said: " A car like this, I can only give it to you at a rate of 24.99% not 11.99%". We refused and he said to Mr Maffucci: "Take them to your office, I don't have time for this". 2nd,Mr. Maffucci said: you have signed all the 32 pages. If you don't want to leave, I'm calling cops". Now, Please tell me exactly what are you planning to do before I will decide If I like it or not. Or, the bank can come and repossess the car and you will get me back my money. I'm not going back down there again to play no more games unless I see something online in writing. Thank you.
