Statement of Claim
"Help my family please we are in desperate need to get our loving dog back that was surrendered without my knowledge to the madison heights welfare society on march 6 aprox 4:30 pm..by 7:30 pm that night when I got knowledge of what was done we immediately started calling unable to get an answer as soon as they opened my husband left work and went to attempt to get our dog back after being labled and no reconciliation the police were called...after hearing the story the police asked for the president of the company information and tamara the heartless staff refused only giving the officer a business card with the normal info to the store...the officer was so bothered by tamara reaction and unwillingness to listen to reason he decided to try and email the president himself....after my husband was unsuccessful I went into the store to explain the mistake and tell how much spikey is loved especially by my children an how this is devastating to them. after 35 min Of talking tamara agreed to give spikey back with the condition that I would pay to have him fixed....she assured me she would help us crate train him and give whatever info we needed...she even ask did I want to see him she gave me 3 hugs stating she is not that bad of a person......she told me I could pick him up tuesday as he would be out for surgery on monday.....well after being assured I told my children the good news especially after learning that my son was crying at school earlier yesterday well I called this afternoon as soon as they opened and thats when she turned into the devil and basically lied and said the board decline the offer and he is gone for ever....she started making up lies saying he was unsafe and dont have all his shots but we have shot records......all we wanted was help as this was our first pet and some how she tricked my husband to surrender.....he didnt know what he was signing...and I wasnt there.....we have been in a depress state since he been gone we need him back....my kids cry everyday and she got their hopes up....Im considering protesting as my husband check with police its legal to do so.....monday we will be contacting a lawyer but im trying any and everything which is why I posted here if there is any advice anyone can offer or direction....please we are more than desperate. .. we believe dogs heal and my son has a severe heart condition and other minor issues and since we had spikey my son has been amazing....I dont understand if they are truely animal lovers why keep him away from love...spikey has rights and keeping him there in that cage with no blanket or warm body and unfamiliar environment has to be shocking and traumatic for him HELP US PLZ"

Respondent's Counteroffer Hide
The claimant's settlement terms were rejected with the following explanation:
  • I disagree with the explanation / grounds provided

"The dog "Spike" was surrendered to us because they stated they no longer had time for him. When Spike arrived, he was not fixed, his nails were extremely long, as in never been trimmed, he was super thin, not at all well cared for. His puppy shots were never completed. Our surrender form clearly states once you surrender a dog you cannot get it back. The husband couldn't sign fast enough. It was very apparent they no longer wanted the dog and we have witnesses to that fact. The husband has come into our establishment several times making bodily threats to our staff. The police had to escort him out. Spike is being adopted into a forever home where he will receive the care and love he deserves. This matter is closed."
