Statement of Claim
Claimant says:
"Mr. Andrew Rosen is an executive manager with the School District of Philadelphia, my employer. He has the responsibility of handling all labor/employee issues for the district, but takes his position too far by allowing school leaders to harm, harass and demean employees who are doing their job at school. Most of the time, the principals who call upon Mr. Rosen, who makes forms for "write ups" of employees easily available on his Department website, are very inexperienced , not handling their school satisfactorally or just need to take something out on someone to feel stronger as a leader.

To this end, Mr. Rosen has allowed four or five administrators to target me for their discrimination while at my school. A school where I ahvd been for 17 years straight and have had a good reputation until a very inexperienced administrator was placed there over two others who were very capable , yet not "politically inclined". They wouldn't be easily controllable by the district, because they were dedicated and experienced school leaders.

I have applied for over 15 jobs with the district and the forms were lost, not accepted or position annuncemernts were pulled, all of the while, I was very experienced and could have done the jobs well. Mr Rosen oversees Human Resources as well, and has the power to "pick his favorites" and degrade whoi he sees as a "problem".

I was assaulted at work and my Workers compensation was not handled properly, by Mr. Rosen who has this as one of his responsibilities ( I have RTK information) leaving me to have my full wages stopped for four months NO PAY AT ALL..and this resulted in his telling them to have me terminated. I got a letter from Amerihealth telling me abut my qualifying event...which meant that they werer going to fire me for abandoning my job??? I was injured and placed back into my classroom with the student who assaulted me. Mr./ Rosen lied and said he didn't handle WC..BUT HE DID> as I found out later.. I am still fighting for my lost pay!!! ( 2010-present)

I have been labelled by many due to his actions, as he tells them I am a trouble maker, not to talk to me and often he sent me emails that I am not wanting to do my job.

This past year, I was transferred to another school, because I was not BILINGUAL, although I taught there for 17 years successfully motivating and educating all students. 1500 are with me today on FB!!!

If it had not been for them, I could not have lived through the retaliation from the district, administrtors that was allowed by Mr. Rosen, and now my early retirement due to the harassment and getting physically ill in a school building that the district refuses to fully inspect for particulate matter in the air or Biological infectious organisms.

I requested accommodations for my physical illness from Mr. Rosen, as he handles these "504" incidents as well. He wrote notes to the School District Dr telling her not to allow me to return to school. YET after three weeks out of the school, as my Dr. instructed me to not go back, I was well enough to be placed into another school. Of course I was npot allowed to go to one of the TWO Biology Positions that were open ( I have a screen shot of the vacancy list) because the Dr. said " everywhere you go there is drama"...What did that mean??? I didn't evne know her...Who told her this??? The person who is responsible for all employees I guess. And "everywhere" was ONE SCHOOL for 17 years...and the next school where I developed a nodule on my Left lung, yet the district didn't believe me, so they didnt evaluate the building .

Interesting though. Many people got very ill last year, and were out for extended periods of time, with Bacterial Infections that had to be treated with antibiotics. Even th4e principal said he asthma has never been that bad. Two of the teacehrs there had air cleaners in their rooms andhad developed occupational asthma.???

Yet Mr. Rosen, who I was told handles the accommodations for employees, would not make a decision on my case. The doctor said it was a legal issue so I had to talk to Mr Rosen. I told her that this was a medical issue, as I spoke to the Dept of labor office and they said that I should have been moved to a new position in another school, not left home to get depressed and hopeless.

Many employees at the school were made to hate me as I had to be absent do to illness and Mr. Rosen refusing to let me go to another location, caused that shcool to ahve differnt substitutes every day. If I had gotten another position, the school could have gotten a permanent teacher, but Mr. Rosen who is executive management in Human Resources/ labor Relations..would not allow anythig to resolve. He placed me in a difficult positiobn, having to l=use up all of my sick days, not collect a full salary again and let the school go without the regularity of a full time teacher of Biology.

What finally happened??? I convinced the Dr. to send me back to work on May 1, 2013. I had been out since Jan/ Feb !!!! Mr. Rosen was given the responsibility to give me an accommodation!!! So, by that time there were not any Bio positions open at any schools so he said he was placing me at a Parent Resource Center. I was told that if I had any questions, I should report to Mr. Rosen...as this was his placement.

I dressed professionally for my placement and went there...TO FIND THAT MY PLACEMENT WAS IN A TEACHER DISCIPLINE ROOM ..with others awaiting disciplinary hearings... what kind of accommodation is that???

It was horrible for me to sit and listen to others issues as I was already full of tension and anxiety. I wrote to Mr. Rosen and told him this, to no avail... No reply at all.

Eventually I became so iinternally anxious that I took my feelings out on someone in an email I was writing to about my son and his ADHD accommodations/ needs.

This caused Mr. Rosen to allow ( I know because I had an email from him) the person, who happened to be my son's principal who promised to mentor my son and didn't do anything for him AT ALL...he then threatened me with termination which was again stressful and impacted my son's education, just as NO PAY, the year before caused him undue stress.

The School District of Philadelphia hasw allowed this man to control and destroy my employment, my physical well being during and after an assault and WCompensation that was never paid except one day, and also caused me to experience tension and lose my composure aft4er he himself placed me into a disciplinary situation, when I didnt deserve it. Needless to say I was embarrassed when I showed up to work and was told I was "REASSIGNED' which means it was for negative reasons to EVERYONE in the district.
Everyone in that office that day, looked at me as if I were a criminal.. Andrew Rosen allowed me to be degraded by others and lose my self confidence by his consistent mishandling of my Assault, Worker's Compensation and my Job Accommodations, which the DOL stated should have occurred when the positions were open, BUT MR. ROSEN DIDN'T WANT TO DO ANYTHING!! I was out of work for 12 weeks...12 weeks!!!! THREE MONTHS.

Does he care about employees, students or the district??? I question it because in all cases nothing was handled with integrity, communication or professionalism...

I am proceeding to file a case with the EEOC against the district and Andrew Rosen as th4e Executive manager who mismanaged all of my situations, which I could not help, YET I WAS TREATED AS SOMEONE WHO WANTED TO BE OUT OF SCHOOL, NOT TEACH AND "REASSIGNED".

ANDREW ROSEN HASW ALLOWED MY HARASSMENT FOR YEARS AND DESERVES TO BE QUESTIONED IN AN OPEN FORUM BY MYSELF, THE DEPT OF LABOR OFFICE OF WORKERS COMP, AND ALSO THE JOB ACCOMMODATION NETWORK... AND THE DISTRICT MUST HANDLE THIS UNPROFESSIONAL "HATE" TARGETTING BEHAVIOR, APPROPRIATELY. IT WAS NOT ETHICAL AND RUINED MY LIFE AFTER 27 YEARS OF SUCCESSFUL TEACHING.

I was forced to retire early, take a penalty on my Pension and also lose money from my pension due to the lack of PROPER PAY which caused one of my highest years pay to go from 90,000 to 56,000.

The resolution of this would have to be a full apology IN WRITING from the School District of Philadelphia and Andrew Rosen, for the mishandling of my employment situations, severance pay for the lack of Pension money in my monthly payments for life and after taking this to the Federal Court...whatever decision they make for compensation to me for the changes to my personality and demeanor ( paranoia, anxiety, intense depression...)DUE TO THE HORRENDOUS TREATMENT SINCE FALL OF 2007....the district will double that amount or more.
The school district will also make a public announcement regarding their errors in judgement against me, and remove all negative files about me . And Andrew Rosen must be reprimanded for his misuse of his power, and have his employment questioned and maybe ended with the district.

FOR I AM NOT THE ONLY PERSON SUFFERING...MANY DID AFTER ASSAULT AND NEEDING ACCOMMODATIONS....It is just that I am willing to SPEAK UP for what is right!!!


The document I am attaching describes what was allowed to be done TO ME by Administrators who contacted A. Rosen, and he KNEW WHAT THEY WERE DOING.

He allowed my pay to stop for 4 months and also initiate my Termination of Employment and Medical Benefits from Amerihealth...I have emails abut my Workers Comp that was nev er paid to me...and all documentation to implicate him, his Human Resources, Labor Relations Department, Workers Compensation Dept and Medical Dept which handled my accommodation/ respiratory illness INCoRRECTLY according to the Dept of Labor."
