AHS is continuing to use the "Policy owner requested AHS buy out option", as a cover to deny their contractual obligations to the policy owner and the repair requested. This is what I get for asking what the cash amount for a "buy out" would be ? Answer, "$174.50", upon a "receipt of an itemized, paid invoice".
This "buy out" is impracticable, as I paid the subcontractor, Carter Plumbing", $75.00 for a service call. Therefore, tearing out a bathroom tub / shower wall consisting of sheetrock and ceramic tile, removing old plumbing, installing new plumbing and fixtures and replacing the tub / shower water proof sheetrock only coast $100.50 ? The estimates that I procured are $1,050.00 and that is without the plumbing fixtures. I purchased the plumbing fixtures, because our home is 64 years old and Carter Plumbing stated that they would not be able to find the original fixtures, at my expense of $100.00. That makes the total $1,150.00.
The received AHS Home Warranty Contract, for the year of 5/28/2012 - 5/28/2013. AHS reference to Section H-3, Section H-5 and Section L-4 is another excuse again for denial of contractual obligations to the policy owner. My copy of AHS Home Warranty Contract for the year of 5/28/2012 - 5/28/2013, does not have Section H-3, Section H-5 and Section L-4.
Section H-3 is about wall coverings. Page 11, Section D, Item 1, NOTE: AHS "will return access opening to a rough finish". I am not requesting wall coverings, only that the access opening be returned to a rough finish.
Section H-5 is that AHS is not responsible or liable for property damage and that I have to contact Carter Plumbing for the damage to my concrete driveway and to my front porch concrete., do to the plumber welding copper fittings without any protection for my concrete. AHS Home Warranty Contract, Page 7, Q. How do I know my service contractor is qualified ? A. AHS ensures service contractors are licensed and independently insured. Performance is monitored to make sure you receive professional, quality work. Your satisfaction is a top priority at AHS.
The best is last. Section L-4 cancellation. My AHS Home Warranty Contract, Page 16, K - Cancellation. Good luck on any cancellation or refund, as this is worded only for AHS to make the final discussion.
AHS does not recognize that Carter Plumbing did install the new plumbing and fixtures in our bathroom, but AHS does recognize the picture that I sent of the new plumbing bathroom repairs.
I am confused ? AHS contends that I excepted a "Buy Out", refuses to make the requested Home Warranty repair. Carter Plumbing installs the new plumbing and fixtures, AHS "The pictures you submitted document that the tiling was removed....." See attached pictures of the new plumbing installed by Carter Plumbing. Did Carter Plumbing invoice AHS for the installation of the new plumbing and fixtures ? Would AHS payment to Carter Plumping nullify the policy owner "Buy Out" ?
My repair request has been denied since September 9, 2013, it has now been five months and the repair still has not been completed. This includes over 52 phone calls, many e-mail's and several letters.
