Statement of Claim
Claimant says:
"Have ben requesting a repair for my tub / shower for 75 days. American Home Shield states that I have requested a cash buy out. Other excuses, bathroom wall has to be removed - done , part on order, check to see of part received. I have purchased NEW parts and they have been at my residence.

Documentation very difficult, as AHS only correspond by telephone, so there no records, only theirs.

    This in answer to my PeopleClaim.com e-mail, received January 13, 2014.

    As usual AHS is dictating as to how they want to settle our claim, to their financial advantage. AHS proposed "Buy Out" is for $174.50, I have quotes for $850.00 plus tub / shower replacement parts $117.09, repair for tub drain $21.57 and miscellaneous plumbing hardware of $64.59, to which I have paid out of pocket. That would be a total of $1,053.25. Then to add insult to injury, AHS will pay this "Buy Out" only with a submit itemized, paid invoice. Really ???? Do I think that this will be paid in a timely matter ??? If paid at all ??? I am sure AHS will refused to pay the "Buy Out", because I did not use an AHS approved contractor !!!!

    This AHS said, We said has been going on since September 4, 2013. Yet today they are still using the same old excuse "Carter Plumbing has reported to AHS that the plumping repairs cannot be completed without the valve and that the back wall and / or tiling need to be removed so that access can be made to complete the repairs". This is false as wall access was completed as soon as I was told that this was required. In December Carter Plumbing showed up and installed the new plumbing repairs, using my parts and soldering the copper tubing on my driveway and front porch, leaving the concrete damaged. See attached picture of the current situation for the plumbing repair, installation and concrete damage.

    AHS, according to the Home Warranty Contract, Page 11, D. 1. Plumbing System, last paragraph, "AHS will cover up to $500 for access, repair or replacement (including returning access openings to a rough finish)". This would far exceed the "Buy Out" of $174.50. As of January 14, 2014, AHS has refused to complete this repair by not completing the replacement of the rough finish in our bathroom.

    I have requested that the contract with AHS be canceled and a refund be issued. Another dead end, as AHS is to determine if the contract will be canceled and if a refund issued. Another, Really ?????

    I have made many, many, many phone calls and e-mail's, however I have not receive any return phone calls or answers to my e-mail's. Apparently I am on some sort of "Black List". It wasn't until I submitted this PeopleClaims.com complaint that I have received any correspondence from AHS for a several months.

    I would like my bathroom repairs completed as per the AHS Home Warranty Contract, reimbursement of my out of pocket expenses, compensation for the damage to my concrete and our contract canceled as of October 2013.

    Mss. Nelson,
    AHS is continuing to use the "Policy owner requested AHS buy out option", as a cover to deny their contractual obligations to the policy owner and the repair requested. This is what I get for asking what the cash amount for a "buy out" would be ? Answer, "$174.50", upon a "receipt of an itemized, paid invoice".
    This "buy out" is impracticable, as I paid the subcontractor, Carter Plumbing", $75.00 for a service call. Therefore, tearing out a bathroom tub / shower wall consisting of sheetrock and ceramic tile, removing old plumbing, installing new plumbing and fixtures and replacing the tub / shower water proof sheetrock only coast $100.50 ? The estimates that I procured are $1,050.00 and that is without the plumbing fixtures. I purchased the plumbing fixtures, because our home is 64 years old and Carter Plumbing stated that they would not be able to find the original fixtures, at my expense of $100.00. That makes the total $1,150.00.
    The received AHS Home Warranty Contract, for the year of 5/28/2012 - 5/28/2013. AHS reference to Section H-3, Section H-5 and Section L-4 is another excuse again for denial of contractual obligations to the policy owner. My copy of AHS Home Warranty Contract for the year of 5/28/2012 - 5/28/2013, does not have Section H-3, Section H-5 and Section L-4.
    Section H-3 is about wall coverings. Page 11, Section D, Item 1, NOTE: AHS "will return access opening to a rough finish". I am not requesting wall coverings, only that the access opening be returned to a rough finish.
    Section H-5 is that AHS is not responsible or liable for property damage and that I have to contact Carter Plumbing for the damage to my concrete driveway and to my front porch concrete., do to the plumber welding copper fittings without any protection for my concrete. AHS Home Warranty Contract, Page 7, Q. How do I know my service contractor is qualified ? A. AHS ensures service contractors are licensed and independently insured. Performance is monitored to make sure you receive professional, quality work. Your satisfaction is a top priority at AHS.
    The best is last. Section L-4 cancellation. My AHS Home Warranty Contract, Page 16, K - Cancellation. Good luck on any cancellation or refund, as this is worded only for AHS to make the final discussion.
    AHS does not recognize that Carter Plumbing did install the new plumbing and fixtures in our bathroom, but AHS does recognize the picture that I sent of the new plumbing bathroom repairs.
    I am confused ? AHS contends that I excepted a "Buy Out", refuses to make the requested Home Warranty repair. Carter Plumbing installs the new plumbing and fixtures, AHS "The pictures you submitted document that the tiling was removed....." See attached pictures of the new plumbing installed by Carter Plumbing. Did Carter Plumbing invoice AHS for the installation of the new plumbing and fixtures ? Would AHS payment to Carter Plumping nullify the policy owner "Buy Out" ?
    My repair request has been denied since September 9, 2013, it has now been five months and the repair still has not been completed. This includes over 52 phone calls, many e-mail's and several letters.

American Home Shield (“AHS”) is in receipt of a letter from PeopleClaim.com advising of a complaint that was filed by JW Marek. The letter has been forwarded to me for review and response.

AHS dispatched Carter Plumbing to diagnose any problems with a plumbing valve. It has been reported to AHS that the plumbing repairs cannot be completed without replacing the valve and that the back wall and/or tiling need to be removed so that access can be made to complete the repairs. Please be advised that AHS will only provide coverage for access through unobstructed walls, ceilings, or floors. AHS does not provide access through tiling or stucco walls. Therefore, you are responsible for any non covered access charges.

AHS has offered a reimbursement in the amount of $174.50, upon receipt of a paid invoice, for the covered valve replacement. The reimbursement amount represents AHS’ cost to replace the covered plumbing valve. As referenced above, AHS does not provide coverage for the non covered access. Upon AHS’ receipt of an itemized, paid invoice, a check in the amount of $174.50 will be forwarded to you.
