Statement of Claim
Claimant says:
"Capital One Bank aided a fraudulent client called Danny Capellan defraud me of $2,200.00 when he promised buying my timeshares and asked me to wire the amount as closing cost into his account. When I realized it was a scam and contacted my bank to re-call the wire. Capital One informed my Bank they had put a hold on that customer's account and that I should complete an Inter-Bank Hold Harmless Agreement and they will send me back my funds but when I did so they only sent me a check of $683.06 without any explanation. Up till now have NOT told me when I will get the rest of the $1,516.94 back."

  • So is the issue that Capital One knew, or should have known, that their customer is a crook?

    Usually wired money is like cash, which is why you shouldn't wire money to people you don't know. My guess would be that he was withdrawing the money as fast as it came in so it seems lucky to me that there was anything left in the account - possibly Capital One has shared whatever was left between several victims. They really should have given you an accounting if that was the case.

    However, I don't know the law on this and I'll be interested to see if anyone else does. Please update when you get answers.
