Statement of Claim
Claimant says:
"I had just moved to Conyers, GA July 8, 2010. Mr. Jefferson was coming in the community or leaving. He stops at my home on 7/8/2010, he introduces himself and said "if I need any work done he's reasonable and that he has done work at other homes in the community and had pictures". I said ok and will give him a call. On 7/9/2010 Mr. Jefferson stop by again in the process of chaos. I told Mr. Jefferson that I was busy, tried, exhausted and brain dead but he kept talking how he's reasonable and not trying to make a lot of money but just trying to making a living or something like that. He kept talking I told him what I wanted to have done to the property; he said I measure the area and give you a price. So I said ok. He said "let me go to my car and get something to measure the yard". After he did that he gives me a price, I said "let me write it down so I can remember". But he had everything with him when he returns from his car. Mr. Jefferson wrote what everything would cost and explained "if he does the work I would give him half down and reminding when job is completed". Mr. Jefferson never said that it was a Proposal/Contract/Invoice or anything before me signing the paper. He called me couple of time after signing the paper explaining that he would do the best job and someone else might not do what they suppose to do. I explained to him that I understand and I'll call you and let you know what I'm going to do. That day on July 9, 2010 Mr. Jefferson totally takes advantage. I was tried, exhausted and delivery people coming & going.

Mr. Jefferson called me August 13, 2010 ask how everything was going. I told him that someone had already laid the concrete for me & that I have someone else to do the fence a company. Mr. Jefferson said me "that I had signed a contract with him". I told him "I did not know it was a contract". Then he asks me did I still have the paper? I said "I think so I'll call you when I get home" and he kept saying "I signed a contract" and I said I'll call you when I get home.

I called Mr. Jefferson back and told him "I have the paper and I did not know that this was a contract". I explained to Mr. Jefferson "I told you that I was busy, tried & brain dead" and I did not know that I was signing a contract. He stated to me "your brother was there, he should have read it to you". I stated "my brother didn't have anything to do with this". I proceed to explain to Mr. Jefferson that I have never seen a contract like this one before. I'm not from George, I'm from Boston and the entire contract I've seen it would be 'Contract Sheet' or 'Proposal sheet' or 'Invoice sheet' not one in all.

We proceed to talk and he told me that he’ll give me until Saturday or Sunday to let him know what I was going to do because was counting on that money and to resolve the problem I should give half of $4,479.00 for labor because he was counting on that money. I told him you don't tell me when I should call you. So, he changes it and said I'll give you 7 days.

So I explained to Mr. Jefferson that I need to find out what my legal rights are and that I have never seen a contract/proposal/invoice all-in-one.

I need help with this.
