Statement of Claim
Claimant says:
"I purchased an Air Condition unit, Soleus Air, in June 2004 for my garage and it was installed. It was doing a very good job in keeping the garage at the temperature that I had it set at for the first 4 years. then there was a problem. The seller , Pitzer, had to replace several parts which were under warranty at no charge to me.
Then the fan motor had to be replaced in less than one year at no charge to me. This second fan motor failed also with in less than one year at it to was replaced at no charge to me the customer. The third fan motor also failed in less than one year. Pitzer adviseed me that the motor was no longer avaiable and the defective fan motor could not be repaired. That was in May or June of 2010.
1) Pitzer Proposal offered to replace the fan motor with a used motor at a cost to me of $533.35 which included labor and tax and no warranty on the Soleus unit
or the fan motor.
2) Pitzer Proposal replace current Air Handler with Air Handler from shop( No Warranty)
labor and tax for $2,105.54.
3) Pitzer Proposal,Install a new Heat Pump 2 ton mini split for $3,728.31 , includes 5 year parts and labor.
I replied to Pitzer that the three proposals were unaccatable and asked them to reconsider,their reply was trhat was the best offer they could make. I have had no service from this A/C unit for over 1 1/2 years.
I told them that the third fan motor was still under warranty when it failed and should be replaced with out any charge to me.
The unit involved is a SOLEUS AIR *

  • I agree that Mr. Holman has a right to be upset. I probably would be too if I were in his shoes. The problem here is he is upset with the wrong party.

    Our company sold and installed the unit mentioned in Mr. Holman’s complaint, however, we did not manufacture the unit. The challenge with this whole claim is that the manufacturer has gone out of business and there are no longer any parts available. This is beyond my control. I cannot get a motor from the manufacturer for his unit, again, because they are out of business.

    I did send Mr. Holman a letter in May with 3 options, one of which was to take a motor/fan assembly out of a unit we have in our training room and install it at cost. The second option was that he could have the whole indoor unit from our training room at cost or he could get a new system installed again, at cost.

    I don’t know how we could be any fairer.

    Let me reiterate, the unit he has in his home was installed 8 years ago, the warranty expired 3 years ago and the manufacturer of his unit has gone out of business. There is nothing we can do, other than the proposed solutions I sent Mr. Holman in May.

  • After checking the website provided by the claimant, it seems that any available warranty is limited to a period of one year from purchase. Also, even if any additional warranty or coverage protection was offered or purchased by the claimant, most likely that would have expired some time ago. Unfortunately, based on the information provided by both the claimant and the other party, it seems that this is a unit that is not covered by warranty, and does not have available parts for repair or replacement. Per Arizona State Law, it seems that there is no right to recover damages outside of any written warranties.
