Statement of Claim
Claimant says:
"He was hired to put a new sub floor down and then pergo on top. He was to take out the old rug that had urine on it for cats, which is why I replaced the floor. He was to dispose of all materials after job and return skirting back in place and put down finish molding between rooms. The reason for the new sub floors was because cats smell urine where ever another animal has urinated. Well he didn't do the sub floors that he was supposeded to do, he just sprayed some urine spray that hasn't worked. I was at work when he did my floors, otherwise I would not have let him do this. He also told me the job would take two days and it's still not finished. I had to rent a truck to hold my furniture till the job was done. It should have cost me seventy dollars, it ended up costing me around three hundred because he only worked a 4 hour day.

I also had him do my roof which he charged me eleven hundred dollars to do and told me that I couldn't get the type of roof I wanted, a rubber roof . But after finishing it he told me that he would now research it to get me one so I called two other roofers, since I now had doubts, who told me that the work he did should have never cost more than four hundred dollars and I could of had the roof I wanted that i that he i could not. The cats are now returning right back to the spot that the previous cat I had pee'd. I feel this man is a liar and a thief and has
taken advantage of me since I know nothing about construction

  • As I explained to Vern when I asked him to do this job for me, I have cats and cats will go to the same spot to urinate if they can smell the urine. Vern failed to remove the sub-floors(which was part of his job I asked him to do) so the cats continue to urinate in the same spot. Also I asked him to show me his recites for the roofing materials he used so I could better understand his pricing but he failed to show me them.

  • Also removal of materials used in a job are part of the contractors responsibility to take away and clean up after themselves which he didn't do he made me pay extra for it then come to my job and got me suspended for a week without payy

The claimant's settlement terms were rejected with the following explanation:
  • I disagree with the explanation / grounds provided

    "1) Trailer Sub Floor
          Carpet removed by claimant when furniture  was removed and disposed of       by mobile park.
           Urine had eaten  two holes through particle board down to the insulation which indicates that this problem has existed for a long period of time. Cats will 
    Not likely do this unless litter boxes are not kept clean and once they start it is hard to break the habit.
           Entire existing sub floor was sprayed with urine odor eliminator than covered with a new 1/2" plywood subfloor and finished with laminate oak flooring. So her claim is completely false.
           
     2)   Skirting around trailer was never removed.

    3) Trailer Roof
           All cracks, seams and flashing were sealed with a layer of Karnack and membrane then another layer of Karnack. This was allowed to set and dry and then entire roof was covered with a heavy coat of Aluminum Emulsion Roof Coating. $450 to patch and prepare roof for coating. $350 to coat and $350 material.
           Colleen was told BEFORE work was started that is was not advisable to use Rubber Roofing because a base sheet needed to be applied first and that it would not adhere properly to the existing roof  and would be a waste of time and money. Not to mention cost considerably more than $1,100."
