Statement of Claim
Claimant says:
"Susan McKisic , RN is a nurse that works at the Upshur County Health Department and has recently faxed an Upshur County client's positive Chlamydia results all over Buckhannon, WV to the Record Delta Newspaper, local library, County Commission Office, etc. along with other personal information and results. This is against HiPAA Law. The County Administrator, Carrie Wallace, called the Health Department and the Health Officer, Joseph Reed, to report this horrific event. Ms McKisic attempted to blame Josh Marsh, Health Department Administrator for the fax mishap but her cover sheet with her name was on all the faxes to which the local offices called to ask why she had faxed this personal info to them. The Health Officer and the Board of Health have attempted to hide this information and after suspending the Administrator, this nurse is somehow the acting Administrator now. Jewel Fisher, Record Delta phoned the Health Department to find out what was going on as to this fax. Susan McKisic then threatened the secretaries Nancy Ketterman and Libby Leichliter to keep quiet about all her faxes and actions. She bullies people at her work and makes threats stating her has a gun in her truck due to her concealed weapons permit and there's nothing anyone can do about it. Her Actions have been reported to the WV RN Board in attempt to protect other clients from her continued wrong doings. She has been written up and reprimanded for her breaking patient confidentiality telling patents' personal health histories to other staff and her friends. She repeats confidential info about clients from the Health Department , Upshur Co EMS, and Broaddus Hospital. She has repeated such stories giving a Soccer Coach's name and about his sexual orientation coming into the ER in Philiippi, WV with foreign objects lodged in his rectum area.
She has also been reported to Susan Hall, WV State Health Department STD/HIV Division , Brian Holmes, State Health Department Division of Personnel, RN Board, and WV State Grievance Board. Laws have been continually broken at this establishment by this nurse. Let's make ensure that justice is served for all the violations she has committed and to protect client's from any further damage she may cause. Also the Board of Health ( including Larry Carpenter, Charliena Eubank, Amy Queen, Teresa Kee, Michael Livesay ) and the Health Officer should stand accountable for their negligence on protecting the citizens of Upshur County and surrounding counties.

    I personally feel that cash compensation would be warranted based upon claimant's assertions. I'd suggest $5000 depending upon what embarrassment and violation of privacy you've incurred. could be higher depending upon what you've gone through.

  • I am not sure what a fair resolution is in this case. I would simply comment that I am aghast that anyone would fax private test results anywhere - I just can't imagine a fax mishap this big. If the patient was consulting with a second doctor, that doctor might need to review medical records, but otherwise there is simply no reason for test results to be anywhere near a fax machine.

    Repeating personal information about patients isn't just about HIPAA violations, it's about personal integrity. I cannot imagine what sort of person would gossip about their patients, and particularly about their sexual orientation. It is the lowest of the low, ethically, and something that many patients, especially in small communities, are concerned about. I've known people who refuse to discuss sometimes serious issues and concerns with their doctor in case it "gets around." If the claimant is correct in his or her assertions, then patients in that area may not be receiving the proper treatment. I would think that the health department should be more than concerned about that. Word gets around.
