Statement of Claim
Claimant says:
"Accepted a multiple pick load with TQL on 12/09/19. Signed Rate Confirmation and started route. After completing 2/4 pickups on 12/10/19, I was informed a mistake was made on behalf of TQL and that I would need to renegotiate the Rate Confirmation previously signed. I told them I was unwilling to negotiate a rate that we had both already agreed upon. I would have never taken the load at a lesser rate for 4 days use of my truck. I was then threatened by Melanie Hunt that I would either renegotiate my Rate or that they would unload my truck at the 3rd pickup and pay me for miles driven. I contacted my attorney for advice and he informed me that I had a legally binding contract and TQL would be held responsible for paying the amount of the Rate Confirmation. I shared this information with Melanie and she responded that she is “no legal expert”, but those were my opinions. I told her to do what she felt was just, either pay me for the Rate Confirmation we signed or unload my truck and have another carrier deliver the load. She informed me she would be reaching out to her own legal team and she would get back to me. After 2 hours, a member of Melanie’s team called my driver directly and told him to proceed to the delivery location. My driver did as advised and head toward delivery location for an on time delivery. After delivery on 12/12/19, Melanie took it upon herself to send a new Rate Confirmation in which I did not sign, nor agree to. I submitted all of my paperwork and BOLS for payment with original Rate Confirmation on 12/12/19. Payment was delayed and I received another Rate Confirmation with an amount Melanie created and again I did not sign or agree to on 12/16/19. On 12/18/19 I received a deposit for this amount that Melanie Hunt agreed to herself. I immediately reached out to TQL accounting and escalating department which still refused to pay the amount of the original Rate Confirmation."
