Statement of Claim
Claimant says:
"My husband and I reserved and paid for a room on July 29, 2017, Thursday. The cost of the room was $472.00 by booking.com.
The small room smelled like mildew. I put the air conditioner on and went outside to the pool on a very windy cool day.
There is no life guard on duty. The railing to enter the pool was broken. I saw 2 pieces of metal in the pool. I held the handle and it came loose and out of the ground. The handle is not cemented into the ground. I have a disability and need a handle.
After the pool, I went to my room for a nap. I instantly smelled the mildew. I tried to get into bed and felt a hard rim on the mattress, very inexpensive and noticeably uncomfortable bed. I lay my head down and the stench was extremely bad, my husband and I had to leave.
I explained the circumstances to the management and they said there is no mildew. They wanted me to go into a nicer and larger room. One of the managers walked me and when I entered the room it also smelled like mildew but not as pervasive as the smaller room. I looked at the mattress - same kind.
I asked the management if we can work things out as I was leaving to go home to Maryland without resting. Management said they would reimburse me but then realized I booked the hotel through booking.com and I would have to contact them. I contacted booking.com and they said (by email) that they have to wait for the Ocean Surf Resort to respond. I wrote two times to booking.com and have not yet gotten an update. Ocean Surf Resort has not contacted me either.
My complaint would be the poor, cheap service with mildew filled rooms and broken handle in the pool.

  • Not only did my husband and not handle the stench, we missed a full day and evening dinner and drive home to MD. $266.00 is an excellent refund for Ocean
    Surf Resort compared to my emotional, stressed out situation and spending another night in Montauk.

  • With my disability (Lupus and Fibromyalgia) I cannot add any undue stress or I will get sick. After coming home without rest from Ocean Surf Resort, I slept for 3 days due to the stress and fatigue of the situation. My reason for going to Montauk (my first mini vacation since 2011) was to relax and rejuvenate. I decided to agree on half the amount so that my fatigue and stress will be lower.

  • What reason(s) does Ocean Surf need a 30 day extension? This claim should have been finalized as I gifted him to refund only 50% of the amount paid to us.
