Statement of Claim
Claimant says:
"On 9 AUG 2012, I entered into a written contract with Cabinet Works of the Northern Neck . I selected single cherry cabinet with granite top for small bathroom and double cherry cabinet with granite countertop for larger (hall) bath. I provided down payment of $1800.00 at the time of entering the contract.
Mr. Gouldman contacted me to install the cabinets, I scheduled leave from work for the day of installation, when I checked to see how installation was going, and I noticed that the wrong countertops were being installed. I made the comment that the counter tops were incorrect. Mr. Gouldman replied that I had looked at different colors, but those were the colors that I decided on. I requested to see the paperwork. When Mr. Gouldman showed me the contract, I pointed out that the tops being installed were incorrect. I told him that I would live with the one for the larger bathroom, but the smaller one needed to be corrected.
When I went in the smaller bathroom I noticed the toilet paper holder was screwed on the side of the new cabinet. I requested that it be removed and the holes filled in.
Mr. Gouldman told me when he presented me with the original estimate that he estimated on the high side for the plumber ($500), but I would be charged for the amount of work the plumber performed. Mr. Gouldman asked me for money ($1850) before leaving on the day of installation, I asked how much the plumber charged, he said that he didn’t know, but it would probably be $500, since he replaced some of the plumbing, and that he would be including the cost of hanging a light, which he did NOT do, I had a friend hang the light after the departure of Mr. Gouldman. My son and best friend’s husband is familiar with plumbing; both are amazed at the cost of installing three faucets and the piece that was replaced.
After Mr. Gouldman left I went in the hall bathroom and noticed the faucet knob to release the sink stopper was too close to the countertop back and hit when trying to lift.
At that point I became very frustrated, I called Mr. Gouldman on 19 SEP and told him that I was very disappointed with the job; the wrong tops were ordered, faucets should have never been installed as they were, and the toilet paper holder should not have been screwed on a new cabinet without asking me first. I requested to have the cabinet replaced if not fixed so I would not be able to tell it was damaged by screwing on the toilet paper holder, and I would accept the top in the Hall bathroom, but I expected a reduced price, it was NOT what I ordered. I also requested to have the boxes returned for the faucet, I would have a friend replace them, I didn’t like the way they fit and did not like it with the countertop that I wasn’t expecting to be receiving. Mr. Gouldman stated that he would replace the side panel of the cabinet, replace the faucets, so I wouldn’t have to get someone else to do it. He returned to finish the job; he replaced the side panel of the cabinet and replaced the faucets. I asked Mr. Gouldman about partial cost reimbursement for the incorrect countertop. Mr. Gouldman stated that he didn’t think he could do anything; he wasn’t making much from the job and went out of his way to make it right. The items that were corrected was due to Mr. Gouldman’s company’s mistakes, NOT mine, the only thing that Mr. Gouldman did for me that wasn’t a result of his mistakes was replace the faucet in the small bathroom. I am VERY disappointed with Mr. Gouldman’s attitude about making a HUGE mistake on his part and turning it around that he is doing me a favor to make it right. I am requesting a portion of the money for the incorrect countertop to be replaced ($450.00). Mr. Gouldman replaced kitchen cabinets for me a couple years ago, he did a wonderful job and I was very pleased, it is like dealing with two different people. I have attached a copy of the contract which clearly states what I originally ordered. Replacing the large incorrect countertop with the correct one would be much more expensive than partial reimbursement, and I, as the customer should not be expected to wait 6 more weeks to complete the job or go through the installation process again. Mr. Gouldman told me that he would talk with the company to see if they could help him with the reimbursement, I did NOT hear back from Mr. Gouldman, the lack of communication is very unprofessional. I contacted my credit card company (Chase) to request partial reimbursement. Chase was unsuccessful with reaching a compromise with the reimbursement. The company's owner agreed to replace the incorrect counter top; however, I have repurchased facets and light fixtures to match the incorrect countertop, so replacing the top after the fact is NOT an option. There will be a cost associated with replacing the countertop at this point; such as, new faucets, light fixture, painter to touch up, and cleaning team to clean behind the reinstallation. The total cost would exceed greatly the reimbursement that I am requesting."

  • Because you actually accepted the countertop, and did not actually create a new contract or get an agreement on a reduced price, you unfortunately may be stuck with the contract, goods, and price that you have. You should consult with an attorney on this basis, to determine if you have remedies that are available to you in this situation.

  • I had the same thing happen with a granite countertop in my new place. I was told once granite is cut it cannot be returned and if you pick it from a sample it may not look exact from the rock it is cut from as each one is a little different. It was my first experience with granite so I just accepted it and have come to love it. It grew on me although it was a shock at first. It was not with this man however I don't think.
