Statement of Claim
Claimant says:
"Purchased a Posture Elite SPF Queen Set from Southern Mattress Outlet 3/10/09, within 6 months mattress started sinking. Contacted Spears on problem, sent out a mattress inspector. Notified by Spears that the problem did not indicated a warranty defect. Problem continue to worsen causing back aches from sink hole. Contacted Spears again concerning problem noting again a SINK HOLE. Spears sent out another mattress inspector on 11/08/13. Unlike first inspection I reviewed the photo, measurements, and pressure test conducted by the inspector. He confirmed that there was a sinking in the mattress on the right side and that this would be in his report to Spears. Letter from Spears (Lora Kempson) stating a Warranty defect was not founded. Called Spears to speak to Lora, called was forwarded to a John (ext 208), left message for a return call (home and cell #). No return call by John or Lora, made several more calls to Spears same day (11/15/13), no return call! Again, on 11/18/13 made several calls to Spears, forwarded to John, left name and numbers again, NO RETURN CALL! On 11/198/13, contacted Spears for the third day, all calls were entered #2 for Lora Kempson, as always these calls were forwarded to John. Left message for John to return my call advising him of my problem. As of this date have not received any response from any one at Spears.

At this point, after Spears have continued to not honor their Warranty on this Mattress I do not want a replacement Mattress, but am requesting a FULL REFUND from Spears Mattress."
