Statement of Claim
Claimant says:
"The owner videotaped my visit, called and harassed my husband, Found my name address and sent me pictures of myself also threatened me with a lawsuit because I made a negative review on TripAdvisor. My husband and I looked for the review but it was missing so I assume trip advisor removed it. My review spoke of mostly the food quality I had no other issue with the restaurant. I saved a copy of the letter he sent me by registered mail."

  • The only justification for South 9th Bistro threatening a lawsuit would be if you were caught on camera putting a cockroach in your meal and then trying to extort money or a free meal for not writing a bad review. I remember reading about something like that; it actually happened.

    If you just wrote a bad review because you weren't impressed by the food,  and the restaurant owner wasn't happy about it, then he's asking for trouble by threatening you with a lawsuit. There are tons of stories online about thin-skinned businesses that threaten lawsuits over reviews and end up attracting lots of very negative publicity.

    I would like to see the letter you were sent. Can you attach it?

    I'm not clear what it would take to settle this. Did you have any ideas about that, or are you waiting for the owner to reach out to you?

  • I read your first comment about being videotaped. Did you feel betrayed by the business owners actions in regards to the videotaping? Or, did you give your permission to the videotaping? second comment, was the actions/manner taken by the business owner towards your husband. The information that you provided in this case if more about emotions. Would you consider a apology for the actions taken by the business owner at this point? either in person or written form? This type of action can be the beginning to resolution or this type of action could be the final resolution due to non monetary value in this case. This type of resolution "apology" is something a person can live with and move on towards the future.  The comment I provided can either be a quick resolution for both of your or it could be just the beginning of the conversation towards resolution.

    I hope my comment may help you both move on towards a beautiful future.
