Statement of Claim
Claimant says:
"Hired by 3 landowners to remove several downed trees which were caused by an April storm. Logs were removed and sold but no compensation paid for landowners share (except for one after 2 mos. of nagging) Fails to honor times to meet and discuss accounting and payment. Unable to leave e-mail messages because the mailbox is full and will not accept any more messages. Very elusive!!!!!"

  • I would expect nothing less, as a response from Mr. Mr. LaFontsee. He never presented an accounting after several requests of the type of trees he had removed, nor the number, nor has he presented an accounting of his activity in this respect. I am going to file a complaint, along with my neighbors involved, to the Department of Forestry for the State of Michigan, as well as retaining legal counsel to pursue this matter. We are certain that Elders Lumber and whom ever moved logs from the properties will be willing to respect a "subpoena" for their records in reference to this matter.

The claimant's settlement terms were rejected with the following explanation:
  • I disagree with the explanation / grounds provided

    "Mr Stephan's should first stick to his complaint only; as he does not have pertinent information regarding the individual contracts I had with his neighbors that he is not privy to. Mr Stephan's contacted me regarding storm damage trees; which my company services. However, we charge for storm damage clean up. The agreement Mr Stephan's and I struck up was we would process his storm damaged trees to include removing main tree stems, chipping up tops and limbwood, and grinding the stumps. For services rendered Shiver Me Timbers would receive the marketable storm damage timber and $2000.00 cash for services rendered. Upon completing the work of removing the storm damage trees, Mr Stephan's changed the contract we had and said he no longer wanted us to do the chipping or stump grinding. I would have never processed his storm damaged trees had I known he was going to go back on his word. First, storm damage trees don't have near the timber value as the stems are stressed, fractured, cracked, and exhibit fiber pull from the forces of being pushed, broke, and up ended do to wind. Still wondering where he came up with his pricing. I haven't seen a scale and grade sheet from him showing this vital information for pricing timber. Since he did mention the neighbors; I feel they used me to get their big, heavy, and expensive blown over trees cleaned up and then canceled the work that was supposed to be paid to me for the harvesting and clean up. Originally they had anyone and everyone there doing there work for free; they could keep the firewood, but they weren't accomplishing the work timely; nor did they have the equipment to he it done. "
