Statement of Claim
Claimant says:
"I PURCHASED AN AUTO LAST YEAR 5/2012, I WAS APPROVED BY WELLS FARGO AUTO LOAN, THE CAR WAS A LEMON, SO I RETURNED IT TO THE DEALER WITHIN 30 DAYS, AND I WAS RELEASED FROM THE FIRST AUTO, AND CHOSE ANOTHER AUTO, I WAS TOLD MY PAYMENTS WERE TO BEGAN JULY 2012. MY PAYMENT WAS MADE ON TIME WITH SANTANDER CONSUMER FINANCIAL. SAME AS TO AUG. SEPT. 2012, I MADE 2 PAYMENTS IN THE SAME MONTH, IN THE BEGINNING, AND ONE AT THE END OF SEPT. WHICH WAS DUE FOR OCT. MY DUE DATE WAS ON THE 20TH OF THE MONTH, AND PER THE CONTRACT, A 10 DAY GRACE PERIOD WAS ALLOWED. IN JAN. 2-13, PAYMENT WAS MADE IN THE BEGINING OF FEB. WHICH I MADE WELL OVER THE AMOUNT DUE, AND I ALWAYS MADE MORE THAN MY MONTHLY PAYMENT. I MADE FEB. PAYMENT BEGINING OF MARCH, AND SO AS APRIL PAYMENT, MAY WAS DUE ON THE 20TH, IN WHICH WAS WELL WITHIN THE 30 DAYS BY LAW TO REPORT TO THE BUREAUS. SANTANDER WOULD HARASS ME SEVERAL TIMES A DAY,AND I STARTED TO KEEP TRACK OF THE MANY CALLS I WOULD RECEIVE IN A DAYS TIME FROM THIS COMPANY. THEY REPORTED ME TO THE BUREAUS AS 90 DAYS LATE, AND CAME TO MY JOB IN JUNE, REPOSSED MY CAR, HAD ME TO PAY ALMOST $2000 DOLLARS, STATING I HAD MISSED 3 MONTHS PAYMENTS! WHEN IN FACT, I HAD NOT MISSED ANY PAYMENTS,AND HAD PROOF TO SHOW FROM MY BANK. THEY EVEN PROCESSED A PAYMENT FROM A THIRD PARTY PROCESSING COMPANY IN WHICH I NEVER AUTHORIZED, WHICH BREACHED THE CONTRACT, AND EVEN THOUGH I GOT MY CAR BACK THE NEXT DAY, THEY STILL REPORTED ME AS MISSING PAYMENTS. THEY SENT A STATEMENT IN JULY STATING I OWED OVER $800 DOLLARS PAYMENTS, WHEN MY PAYMENTS WERE ONLY $423.08 MONTHLY. THEY SENT ANOTHER STATEMENT IN AUGUST STATING I OWED OVER $1,200 DOLLARS AND HAVE TOTALLY SCREWED UP MY CREDIT, AND THREATENING TO REPO MY CAR AGAIN! I CONTACTED THE CFPB, FILED A COMPLAINT,SENT THEM MY PAYMENT HISTORY, EXPLAINING IN FULL DETAIL HOW SANTANDER GOT MY PAYMENTS SO MIXED UP, AND NOTHING HAS BEEN DONE. I SPOKE WITH A MR. WISE AT SANTANDER, THAT TRIED TO TELL ME THE PAYMENT I MADE IN SEPT. WAS FOR SEPT, WHICH WAS NOT POSSIBLE BECAUSE BOTH PAYMENTS WERE FOR DIFFERENT AMOUNTS. HE NEVER ONCE MENTIONED ABOUT THE BREACH OF CONTRACT ON THEIR PART BY USING A THIRD PARTY PROCESSING CO.WITHOUT MY PERMISSION,WHICH THEY NOT ONLY DID AN ILLEGAL REPOSSESSION, TOOK OVER 4 MONTHS PAYMENTS FROM MY ACCT, BUT REPORTING TO THE BUREAUS I AM OVER 90 DAYS LATE, BUT IS ILLEGALLY CHARGING ME FOR PAYMENTS THAT ARE NOT DUE."
