Statement of Claim
Claimant says:
"I purchased my home on 8/29/13,and Kent Miller was the selling agent. From the beginning getting the repairs done on this property was a slow and frustrating process. My bid was accepted on 2/28/13, and the first appraisal was done 4/22/13. Below is the list of repairs:
The dwelling will meet HUD's miminum property standards for existing dwellings as outlined in the HUD Handbooks 4150.2 & 4905.1 once the following repairs and passing inspections are made to home: -INSPECTION BY TERMITE/PEST CONTROL COMPANY DUE TO EVIDENCE OF WOOD DAMAGE AT DOOR FRAMES EXTERIORS & REPAIRS AS NEEDED TO WOOD DAMAGE -INSPECTION BY LICENSED ELECTRICIAN OF BONUS ROOM/FORMER GARAGE(THIS AREA IS NOT PERMITTED BY COUNTY AS FINISHED AREA AND HAS MOST LIKELY NOT HAD THE PROPER INSPECTIONS COMPLETED AS WELL AS NOTED BY APPRAISER AS HAVING NUMEROUS WIRES LOOSE AND UNCAPPED IN CEILING) -INSPECTION BY LICENSED ELECTRICIAN OF WIRING/OUTLETS OF SUBJECT INTERIOR SUCH AS KITCHEN AND BATHS WHICH DID NOT HAVE GFCI OUTLETS(REPAIR AS NEEDED) -REPAIR MISSING LIGHTS THROUGHOUT HOME/UNCAPPED LOOSE WIRES -REPAIR CRACKED TILE IN BATH OF MASTER BATH AND CRACKED MARBLE SINK IN MASTER BATH(LEAK HAZARD) -REPAIR/REMOVE LAMINATE WOOD FLOORING WHERE MISSING AT PORTIONS NEAR DOORS, ETC AS IT IS TRIP HAZARD AS IS. -REMOVE WOOD AT DOOR TO BONUS/PRIOR GARAGE AREA(TRIP HAZARD) -REPAIR BONUS ROOM/PRIOR GARAGE WHERE THE GARAGE DOOR WAS LEFT IN PLACE AS IT IS NOT WATERTIGHT CURRENTLY AND HAS SOME EVIDENCE OF WATER DAMAGE AT BOTTOM PORTION(MOISTURE EVIDENCE AT FOUNDATION NEAR GARAGE DOOR) -INSTALL SMOKE DETECTORS IN KITCHEN AND ON SECOND FLOOR OF HOME -INSPECTION BY PLUMBER OF BATHROOMS FOR WATER LEAKS AS THEIR ARE SEVERAL STAINS BELOW BATHROOMS ON CEILING AT MAIN LEVEL. REPAIR WHERE NEEDED.
After the appraisal a month pass and My agent Tiffany McLaughlin didn't know anything. I went to the house to see f anything was being done. When i arrived the workers were there and they allowed my daughter and I to come and see what was happening. The first thing I saw was the laminate dinning room floor was gone. The appraisal report stated that the broken pieces of the threshold be removed and fixed. Instead of fixing the thresh hold the whole floor was removed. Then I discovered that the kitchen counter looked like it was cut with a saw. I told this to my agent ,and she spoke with Kent , and he claimed the counter top was like that and there was nothing to be done about the floor. But the pictures on the appraisal report proves otherwise, along with the pictures posted on the home path website. My agent was aware of my desperate need to find a place to live, she did little to nothing about my complaints and Mr. Miller saw that and took full advantage of her lack of negotiations. I was allowed to come back after the repairs were supposedly done. On that visit my agent was with me. There were still things on the report that still needed to be repaired. Even worst the kitchen sink counter top was even worst, which is clearly shown in the pictures. The doors to the upstairs Jack and Jill bathroom were still off the hinges.Three doors are broken also a closet door and both doors to the bathroom , bedroom door off the hinge. The fire alarm they put up didn't work and a light switch was still uncapped. The jack and jill bathroom still had loose tiles on the floor. These things are all part of the minimum requirements according to Hud Hand book. The sink in the master bath wasn't fixed either, not until the last appraisal. I went through a program that helps disable people like myself purchase a home instead of renting. It was required that I get a home inspection. The appraiser was required to view the report and do another appraisal. More repairs needed to be done. At the final walk through there were still minor things not done like the doors and the uncovered light switch. The big thing was the bathroom floor in the second bathroom with the loose tiles and the floor that needs to be replaced. The mold found in the garage painted over which I didn't see that until after closing. At this point I cut my losses and decided to go through with the closing and fix the things I knew needed to be fixed. Until after my closing and I took a shower for the first time and everything went crazy. The water started to flow from the walls and when ever we flush a toilet or ran water the water would flow from the wall and the downstairs toilet would over flow, that started on 9/2/13. I also discovered the hot water heater doesn't work. I got on the phone and called everyone I could to help . My mortgage company gave me the name of the plumber who was hired by Kent Miller. I spoke with Lacy Adams and she sent me a email telling me the work they actually did and what was on the report here's a copy of that email:

A plumbing inspection was completed to find out what and where plumbing lines were leaking. We did find and notify the selling agent of the following repairs that needed to be completed:

Water heater missing expansion tank – against code
Replumb under kitchen sink (leaking)
Replace shut off valves for hot, cold and dishwasher (would not open or close)
Replace kitchen sprayer
Replace pop up assemblies in full bath (right sink) and powder bath
Replace shower mixer cartridges in master bath & full bath (leaking)
Replace shower heads in master bath & full bath
Replace tub stoppers & overflow plates in master & full bath

We were never approved by the bank to complete any of these repairs. They could have hired a different contractor, but I’m not sure. The plumbing related repairs that we did complete are as follows:

Replaced faucet at master vanity
Replaced sink at master vanity
Repaired 5 loose tiles in master shower
Replaced a missing soap dish

I requested additional information about the electrical repairs but I got no response. I have every reason to believe that the things on that all these reports were not done. The termite report state a WDo report could not be issued they could say if there are termites or not. I am to believe that Mr. Miller did only minor and visibly proven repairs. I had to have the pipes snaked and roots were found growing in the pipes. Mr Kent sold me a house that was not move in ready and he falsified report to make it appear as though it was"

  • Based on the reports and evidence I have ,I have reason to believe you falsified reports to make it appear all the plumbing repairs had been done . The house has major pluming problems and there are still leaks. The bottom half of the wall that had the water coming from it, has recently been cut out and poorly replaced, why when it wasn't on the report. I have reason to believe it was because of the water that was coming out of it when the repairs where being done. Another cover up move. I am prepared to take this matter to court. Below is a email sent to me stating what was actually done by your people.

  • When I first look at the house the kitchen sink in counter top had no damage and there was a dinning room floor. At my closing the kitchen sink started to fall through, and the dinning room floor was removed, and the dinning room bottom half of the wall was poorly done, which was a cover up for the water damage, the seller had to know about. I have pictures of the areas before the required repairs were done. I spoke to my realtor about all these things and nothing was done. The whole main sewer line had to be replaced, and caused a lot of damage before and after my closing.

What Claimant Wants Hide
Message from Claimant: The damages done to the kitchen and dinning room happened when the seller was doing the necessary repairs for FHA approval. The main water drain collapsed and need to be replaced. The seller falsely reported that repairs were made, but they were clearly covered up to appear as if they were done
1. The seller did damage to the kitchen sink and the counter top which caused thje need to replace the sink because it started to fall through and made the sink unusable, and the dinning room floor was removed along with the bottom part of the wall, which was poorly done Feb 05, 2014 $6,000.00
