Statement of Claim
Claimant says:
"I have been an avid consumer with QVC for many years. I have made many, many purchases along with many returns. Obviously, purchasing merchandising over the TV is open to many variables and it's difficult to always know what your purchasing until you actually have it in your home to feel, smell, taste or use. Therefore, returns are expected. QVC boasts on live TV that they offer an "UNCONDITIONAL" 30-day return policy. However, recently my account was closed because they state that I return too many items and cancel too many items. I believe that this is an unfair practice. If they boast an "UNCONDITIONAL" return policy then they should not make a condition of whether they are making too small of a profit margin on my purchases. I have been sending them $500.00 per month for almost a year, so obviously, I am purchasing items. Please help me get my account opened again. Thank you."

Additional Communication Between Claimant and Qvc Inc Hide
  • May 10, 2012, () added:
  • I want my daughter's account reinstated immediately - she has not been involved in any of this and shouldn't be punished for my actions She is very upset about this because she really buys some needed items from QVC. this is another totally unfair practice.

  • May 17, 2012, Claiming party added:
  • I would also like to add that QVC has recently closed my daughter's QVC account simply because she is associated with me. She does not return items often and doesn't cancel items. She only purchases a few things a year but they said since I am her mother, they closed her account. This is ridiculously unfair. My daughter is very upset because some items she truly liked. Can't we at least keep her account open.

Respondent's Counteroffer Hide
The claimant's settlement terms were rejected with the following explanation:
  • I disagree with the explanation / grounds provided

"QVC has responded saying that every customer should make careful consideration before making a purchase. however, they do not mention that their host/hostesses use extreme pressure techniques to try to make a consumer act quickly so as not to lose their chance to make the purchase. They will say they only have a few left, this item won't be coming back, you must act now or you wont't have another chance, etc. You are highly pressured by very talented people trained by QVC to have a person make a rash decision. Then iin the light of day when the moment has past and you think about it and you wonder, "did I really want or need that". If you try to simply cancel the order they don't like you to do that either - they sent me a letter about doing that. So they don't care about the consumer only about their profit margins. They clearly state that they have an unconditional money back guarantee; however, there does seem to be very serious conditions. Now they have gone so far as to cancel my poor daughter's account because she has been associated with me. Why should she suffer for whatever they claim I have done. Oh, by the way, I was sending QVC $500.00 per month, so I was obviously keeping many items."

  • Maybe the FTC should look into this. It does seem like false advertising and it seems to happen to a lot of people. On the other hand, I saw it as God telling me to quit wasting money on all the junk they sell!

But closing your daughter's account seems ridiculous. Collective punishment?
