Respondent's Counteroffer Hide
The claimant's settlement terms were rejected with the following explanation:
  • I disagree with the explanation / grounds provided

"First, we’re sorry that the used auto business you filed against apparently hasn’t responded to your claim.

    2) Rather than sending this claim to our published customer support address, you delivered it to a deactivated personal email address, used only by someone who has not been with the company for more than a year. Since the only other claim under your name was filed on 2/21/12, could you tell us where you found this address? We need to remove it from circulation; emails sent there will not be delivered. Please use support@peoleclaim.com for any further communications.

    3) When you filed your claim you chose the free email delivery option with no public posting, which limits your claim’s effectiveness. You did choose the multi agency complaint option. Although you didn’t respond to our emails of 3/4/12 or 3/7/12 regarding your claim, we did receive an offline message via the website noting that your claim hadn’t been resolved; we then sent a second letter to the business. The complaint was also copied to several regulatory and media agencies as you requested. We cannot, of course, guarantee when, how and if any of these agencies will step in on your behalf. Many regulators are dealing with backlogs due to budget constraints—see recent article about delays in the court system at www.npr.org/2012/04/12/150429441/sue-me-not-a-chance-this-year?sc=17&f=1001

    4) Posting fees are fully refundable upon request if a claim isn’t resolved 90 days after posting publicly; however, you didn’t pay a posting fee. As stated in the Terms of Use, “We cannot refund charges for Premium services such as postal delivery options or copying claims to regulators, watchdogs, and media.”

    5) Since you paid $7.95 to file this claim (against PC) rather than first check with our support staff, we would be happy to close this claim and apply the posting fee to your complaint against the auto dealership. Public posting would take place after 10 days (or longer, at your discretion) only if the dealership did not resolve your claim. Please email us if you want to take advantage of this offer. Your posting fee will, of course, be refundable under the usual terms, 90 days after posting publicly, in the event that whichever complaint you use it for isn’t resolved to your satisfaction.

    6) Regardless of what you choose to do, we truly hope that your dispute with the auto dealership is resolved in the near future.

A wonderful serenity has taken possession of my entire soul, like these sweet mornings of spring which I enjoy with my whole heart.
