Claimant says:
"We are out of state owners of a rental property in Laguna Vista , TX. We needed the shower demolished and rebuilt in the master bath due to a leak. We obtained 2 bids, which we thought were both high. We, however, chose PCR Construction/ Dev Inc. , although the higher bid which came with a personal referral and a personal statement from Ruben Cazares that he would do a good job. We believed that the job was progressing appropriately until on the night of Memorial Day, 2016 we received a telephone call on one of our cell phones stating he has finished the job and wanted to have a check overnighted to him. We chose to contact the tenant to verify the job was completed to their satisfaction. As a result of this inquiry, our tenant informed us that the 10 year old existing shower door was dismantled and reconstructed using existing materials and a new shower door was not supplied. Our tenant also pointed out that one of the pieces of glass was fractured and Mr. R. Cazares chose to reinstall that piece of glass. When questioned about it, by our tenant, his response was that he did not cover the cost in his proposal. That is unacceptable! Mr. R. Cazares failed to bring that to our attention, as his clients, and failed to present options for correction. We agreed to have the glass replaced in the name of safety and agreed to pay $275.00 for the glass to which Mr. R. Cazares did not object. ( refer to letter dated 06/02/16)
Mr. R. Cazares has been very short on communication, responds to very little in writing and chooses to telephone only the male member of this consumer couple. Many times, 2 and 3 emails need to be sent to him to comply with our requests regarding information.
We outlined our position to Mr. R. Cazares regarding our expectations and position regarding his use of the old glass and the replacement of that glass. Again, no response in writing, but proceeded with the job to correct this matter. When the job was completed he called the male consumer of this couple and stated he emailed pictures and demanded immediate payment. Again, we contacted our tenant and received a statement that it now looked better. Mr. R. Cazares was again on the telephone threatening to turn it over to collection if he did not have immediate payment. The first threat!
A July 13, 2016 letter was mailed, which included a check for the full payment as in proposal and the agreed upon $275. 00 for the glass. We simply requested a copy of the proposal marked "paid-in-full" as well as . He refused to fulfill the request for the receipt.
As a result of these unacceptable responses we have gone on the website of The Office of the Texas Secretary of State to verify the existence of PCR Construction / Dev Inc. We have not been able to verify this corporation. As a result of the inability to verify this information we requested, in a email, documentation of the corporations existence or the company's E.I.N. in order that we are able to file a Form 1099 to be in compliance with Federal law. We also learned that Pedro Cazares is listed as owner and Vice President of the company. When the company phone number is called asking for Pedro we were not able to speak with him. Questioning , does Pedro exist. Mr. R. Cazares response to this corporate information and/ or E.I.N. request was to make another threat that he has contacted an attorney to place a lein on our property and also made inarticulate statements accusing us of being prejudice against him because he is Hispanic, stating we are accusing him of using substandard materials, etc."
