Statement of Claim
Claimant says:
"I brought my dog in for grooming on May 6, 2016. She was in perfect health with no signs of limping or pain. When I picked her up, she couldn't walk. Took her to the vet & found she had a torn ACL, costing me over $700. The groomer has refused to accept any responsibility and refuses to reimburse me for vet bills. They won't even tell me what happened to my dog that would cause her to receive such a traumatic injury while in their company. Have made several attempts to collect, but have been refused."

The claimant's settlement terms were rejected with the following explanation:
  • "Paw Prints retained The Mendel Law Firm, L.P. (“MLF”), 1155 Dairy Ashford, Suite 104, Houston, TX 77079, to represent it with regard to Richelle Gray’s complaint about her dog. While Paw Prints would like to resolve Ms. Gray’s issue, it is unable to do so at this time. For reasons that Paw Prints does not understand, Ms. Gray has concluded that Paw Prints was negligent when there is no evidence that this is the case. MLF has repeatedly requested that Ms. Gray provide an affidavit from her Veterinarian that Paw Prints was the sole proximate cause of harm to the dog. In fact, the last request was dated November 10, 2016, and, as of today, neither Paw Prints nor MLF have received any evidence whatsoever from any person or entity who would swear under oath that Paw Prints was negligent. Absent reasonable proof that Paw Prints was negligent, Paw Prints declines to pay money just because a demand was made. Paw Prints respectfully requests that PeopleClaim.com have Ms. Gray tender to MLF’s office the requested affidavit so that we might be able to resolve this issue. "

  • What was the timeline?

    You took your dog into the groomer - did they comment on a limp when you took her in?

    When you picked her up, was it evident right away that she was limping? Was she able to walk at all or was it just a limp? Did you comment on the injury and ask about it if it was already showing?

    When did you take her to the vet? Same day? Next day? Next week? Did the vet have an opinion about anything that could have caused that particular type of injury, e.g the dog falling off a table, being grabbed too roughly, trying to run away, etc?

    What breed is she? Is she one of the breeds more vulnerable to such injuries e.g. Lab, Rottweiler, Shepherd, Golden etc?

    Is she obese? How old is she?

    I read the company response and it seems rather glib. Asking the vet to swear that the injury was caused by negligence or rough handling at Paw Prints Dojo is ludicrous. The vet can't even swear that the dog was there at all.  Any court would look to the PROBABILITY of the injury occuring there, not 100% proof. Answers to the above questions would help the court to determine probability. The vet knows the dog: asking him for his gut opinion might be helpful.

    I would think that Paw Prints Dojo would also want to know the answers --if there's someone at the business who isn't handling dogs well, they should want to know about it.

    I hope that the dog's owner is also open to thinking fairly and reasonably about whether the injury really was caused at Paw Prints Dojo or could be an emerging issue of age, obesity or breed. He or she will know the truth of whether there was a staggering (literally) difference between drop off and pick up.

    When issues aren't black and white, both parties have to really take a deep breath and be completely honest and ethical in sorting things out.
