Statement of Claim
Claimant says:
"He had been working on my Moms computer a few times. I thought he was ripping her off. So I started staying with her when he was there to see what he is charging her. Please note: My Mom has had two strokes and I honestly think he took advantage of her. He never returns phone calls or texts to tell us that he will be late. My folks are in their 80's and go to bed about 8pm. On one night he told my Mom that he would be there by 5pm. He was late, and he never called us. I left him a message as it was about 830pm to just come over another day earlier. He never picked up his phone. Well, he showed up at 9pm. We were all falling asleep. He gave no excuse as to why he was late at all. Anyways, he was there for a little over an hour and had the nerve to charge my Mom 180.00 and told him there is no way that she will pay that, he was late and never called us. He dropped the price down to 140.00 which was still too much. My Mom just paid it and said to him its late. Ill deal with the price later.

A few weeks ago he came over again and was fixing the computer, which I don't think he fixed the problem the last time he was out. he was dressed like a slob and he knew that my Mom had a stroke and she could not understand him as he spoke to fast. I asked him several times to slow down and he didn't.

He also mentioned to me that he had another WI-FI unit he was going to bring to me. When he got here I offered to make him four Christmas ornaments to trade for the (cheap) Wi-Fi unit. He had no problem with this, so I made him the ornaments. He spent about an hour here and really we never knew what was wrong with Moms computer.

After he left, I went into my room and the Wi-Fi- unit that he had given to me was gone. He made a trade with me for the ornaments and he took it with him. He also took my Mom off the team viewer. This is when they can talk online to work on the computer.

I called him several times and texted him and he never got back with me. I did write him a letter to ask him why this has happened and why he took the Wi-Fi unit. And took my Mom off the team viewer.

This is not the way you treat people, especially senior citizens!!! I feel that he took advantage of my Mom. This man never ever calls back to let us know if he will even be here.

I am afraid that he just might have taken important information off the computer. Like account numbers etc. I don't know this for sure, but after all of this awful treatment I would not put it past him.

It would be nice to get back some of the monies my Mom spent on him also. I don't know what we can get from him. But he sure charged a ton of money for an hour of service and being over four hours late. Honestly, I would like to get at least 100 dollars back from that visit he charged my Mom 140 dollars for. Who knows what he charged her before I came along to start taking care of her business since she had a stroke.

I don't want any problems with Dusty. I just want what is fair."

  • Dec 19, 2016, Paul (Dusty) Chapin IV (responding party) added:
  • I do not understand how you think you can file a claim requesting a refund of your mom's money when she does not feel I have ever been anything but generous with her in regards to billing her. She also holds me in the highest regards and for the last SEVERAL years has trusted me implicitly (these 8 or so checks from her from the past 5 years showing that she keeps calling me kind of shows at least a little trust...).

You have never paid me a dime, and the one time you asked me to do something you could only pay in ornaments...I was being kind, because I like Beverly, and accepted. Did you not notice that I did not charge for any of that night, nor did I charge for the 2 hours of remote support the night before trying to get your printer working!

That is all I can say...my attorney has advised me to say nothing more to you then the fact that if this claim goes public we are suing for Defamation of Character using libel as a medium...and have already won.
