Statement of Claim
Claimant says:
"On July 17th,2014, I had an appointment to have my hair cut and partially colored to eliminate some of the grey. The operator, Sherry Kazemi, was told enphatically to leave some grey to effect a color known as slate. She stated that she knew how to accomplish same and proceeded. The first procedure left my hair brown with no grey left. I asked to make it a little darker. She then used permanent color and my hair is now the color of an egg plant. She and others in the shop attempted to eliminate some of the damage by washing my hair repeatedly. She then put bleach on my hair and severely burned my scalp. When I expressed my displeasure she said" You didn't leave the bleach on long enough. I immediately went to another salon named Aria and they were extremely concerned about my bleach burns, the jaggedness of the cut and the horrible color. They treated my scalp with a soothing lotion but could do nothing with the color as it is permanent. The cost for Aria was $55.00. The bleach saturated my collar and ruined my shirt. The shirt was bought from Fredricks at the cost of $70.00. To add insult to injury, Ozlem charged me for the incompetent work on my hair. I believe $60.00. I demand the total of-$185.00. If not reimbursed immediately I intend to file law suit and file complants everywhere possible."

Message from Ozlem Hair And Spa: Mr. Gisclair,

After reviewing all the information about this incident, I have come to the conclusion that as an offer of good faith, I would be willing to refund the money you spent on the color services. We cannot pay for your alleged shirt damage because due to your own admission, you said you noticed the shirt "damage" when you arrived home that evening, yet you waited for 8 days to elapse to make this alleged claim. Thus we have no way of validating that it is the same garment worn that day nor whether the damage was caused by an error by the staff. In addition, it was brought to my attention that you were quite rude to my staff including Pat, our receptionist, who informed me you did NOT ask to speak to the manager at any time during the checkout process. In fact, she told me you purchased a product and stormed out of the salon, leaving it behind. Also, you questioned Ms. Kazemi's competence yet your wife has been a customer of hers for a number of years without incident.

Consequently, for the above reasons I can offer a return of your color service charges only.

Kindly let me know your decision.
