Statement of Claim
Claimant says:
"I went to get an oil change for my father's car that I usually use to go to work with. Long story short, I went in there and was unsure of the year for the car, so I told them I believe it's a 97 (when in fact in the end it was a 95). The oil express employees worked on the car and ultimately put in a 97 filter (which was way too small for it). A couple of days later on my way home from work the oil light came on and I turned back to work because the car had a rattling sound to it from the engine and I smelled a burned scent. The next morning my father and I went to look at it and figured maybe there was an oil leak somewhere. We discovered that the filter was not screwed on sufficiently and was coming undone. We called the oil express people for a tow truck and they said they would come to look at it first. (Which was over 27 miles), and we couldn't wait that long so we said we will call our own tow truck company as long as they pay for the expense. They agreed to do so and we brought the car to a mechanic where we also met with the oil express employee. Turned out that the filter was wrong for the car and was too small and the oil express employee said they were not liable because they followed what I wrote down on the invoice (97 for the make of the car). Even after I expressed that I said I was unsure I assumed they would check it out themselves seeing as that was their job and profession. They did not want to cover any expenses and my engine was gone. It took some arguing to at least have them pay for the tow since they said they would, but I believe this is not right. I had to pay out of pocket to fix the engine while they got away with a clean slate and not claiming any responsibility whatsoever even though it was also under warranty. Are they right to not have any responsibility? Am I wrong for being unsure of the car year? Is it not their job to check the oil filter and make sure at least it's the same size as the previous one that was in there?"
