Statement of Claim
Claimant says:
"Been "working" with OCWEN since 2009 to resolve our account. Things started getting messy when they when they incorrectly paid the wrong insurance company two years in a row. Then, in 2009 we started getting late notices and phone calls from OCWEN representatives in India stating that our mortgage was past due because a payment was missed on X date. We would diately provide proof of payment to their "research department" who would consistently "not receive it". I finally discovered a physical address to FEDEX all proof to. Even with the FEDEX delivery proof, it would still take several weeks to acknowledge receipt of the documentation.

Each time, when we called to follow up, we were told that actually they did receive the payment on X date, but it was actually the one on Y Dqte that they did not receive.

In the meantime, they continue to charge late fees and ruin my credit even though we never (not once) missed a mortgage payment to OCWEN.

Things seemed to get even worse when I notified OCWEN that I had kidney cancer and they probable saw an easy foreclosure target because of my cancer.

I have never seen anything quite like this, but their lies and deception literally continued for greater than 3 years when we received a "Notice of Default" on our mortgage. After we received the Notice of Default (after never missing a payment), I simultaneously FEDEX'd documented proof of the latest payment they said they did not receive while I applied for a refinance.

After 30 days, we received a letter from OCWEN stating that even though HUD required them to answer us within 30 days regarding our latest research request, they are taking an additional 30 days.

I was happy to close on our refinance two weeks ago, but was shocked when we discovered (after receiving attorney solicitation letters) that a Lis Pendins had been filed against our home with the county courthouse.

I also received a voicemail from someone (Droomil?) from OCWEN stating they did not receive the closing documents along with the payoff check from the closing attorney on our refinance. I provided the "missing documents" immediately to a covert email address he gave me but have been unsuccessful in obtaining a courtesy response from Droomil indicating he received the documents that were "missing". the Closing Attorney says they send the required documents along with the payoff check, and that it was received prior to the payoff date in the approval letter.

OCWEN's lies, deceit, and incompetence have ruined my credit and now my reputation (Lis Pendins filed in public record) which will cost me future business (a Lis Pendins does not look good to future customers)..

I will do everything in my power to have my credit corrected like OCWEN promised, and I will do everything I can to publicize the deceptive business practices of OCWEN Loan Servicing as many other have done. If I can save one person from the incredible nightmare of OCWEN, I will be happy.

I will not rest until my incorrect negative credit has been resolved, and until the Lis Pendins has been deleted from our county courthouse as that negative and incorrect filing will cost me considerable business.

If OCWEN truly started their lies and deception because I had cancer, I will make it my mission to get the word out in a major way.

Many folks have posted about the deceptive business practices, and ex-OCWEN employees have testified as to the incentives and practices of driving folks into foreclosure."
