Statement of Claim
Claimant says:
"I have 9 storm windows along with a ladder the above company has let at our house since February 2013.
The company sales person misrepresented the company and lied constantly about who they were, the number of employees, etc. They came to install windows and had no permit. In the mean time my husband was told he would be losing his job in July and we were financially unable to have the windows installed. We have request over & over again to the company both the sales person and the owner to please come and pick up the windows which have taken up quite a large spance in my enclosed porch. Their response to us was they had no place to put the windows. I can't use my ( small ) porch and really need to have the windowa removed. My husband has offered to rent a truck and return them however, once agian they said no, they had no place to store them. Could you please try and have the situation resolved. Thank You."

  • The last thing we want are unhappy customers. We are sorry that you don't want the custom vinyl replacement windows that were custom made for your home. We have a contract dated December 30th. You called us that you wanted windows. We have made beautiful windows for you and we had been trying to install them all winter. The law states that you have three business days to cancel a contract in writing. You did not. Our men measured the windows and you knew that we were ordering the custom made windows and you never said don't order them. You made it very clear that you wanted us to only install them only on the weekends. It seemed that every time we set up a date to install them we had a major snow storm and you didn't want our men walking on your new carpet. We understood completely. Then one of the weekends our foreman's brother passed away and we had to rescheduled. Then you told us why don't we wait until spring. Again we completely understood. Now you and your husband don't want the custom made windows and you think we can just take them back. This we don't understand at all. We have been trying to work with you to resolve this matter.

  • We told your sales person Buz, that we had an unexpected financial situation k, that being that my husband was going to be losing his job. You could not have cared less. You sent us a letter stating some other payment option which once again we are in no situation to accept. I firmly believe that after being told by sales person Buz that 100% of the financing is done by your company, yet a few weeks later Buz was asking for $1400.00. I had original told Buz in the three hours or more that he was here that I would prefer they windows be installed in the spring because we were in no hurry and didn't really want them done in the cold weather. Once again our request fell on deaf ears of someone who couldn't care less about what we wanted. Too many warning signs started to show up early on.....never a permit, the salesman fell and hurt himself, someone passed away, complete lies about your company being big and making windows for other companies, ie, Champion and others. Along with our financial situation other things just didn't seem to add up. Plus you only heard about our situation when we had to call you about someone not showing up only to find out Buz called you at 10:30 PM the Friday before to say we called him and cancelled which was an outright lie. As far as sending a letter with different term goes, if my husband losing his job and not being able to pay for the windows, how on earth did you think we could come up with the money? We NEVER said we didn't want the windows, what we said was we were unable to afford them at this time.
    What is it that you don't understand ??

  • Also I'd like to add that when the salesman ( Buz) came to our home he said we would have to sign that day ( December 30, 2013) to get $1500.00 dollars back.We never heard anymore about the $1500.00 dollars only that he asked for $1400.00 a few weeks later after telling us the company financed 100%. It seemed the deception just kept going on and on starting with the salesman stating he was half owner of this company. When I asked Mr. Prunier what the salesman (Buz) title was Mr. Prunier replyed & I quote: "he was a manager and stated that that was just Buz being Buz". He never apologized about any of the lies told to us, ie. large company, made windows for all the other companies, etc. I only found out the the BBB that the company 0nly employeed 4 people. If this whole deal doesn't scream deception I don't know what does. If trying to work with us is just suggesting one option, I guess your definition of working with us is quite different than what others have stated to us in similar situations. We believe your company and your salesman ( Buz) is deceitful and your marketing practice is very high pressured ( who stays more than three hour to talk about the installation of nine first fall window and would not leave even after we stated that $ 10,000. was a very High price) he just kept repeating the same thing over and over using the " wear these people down" TACTIC ! As far as the windows being beautiful they are exactly like any other replacement window. We never cancelled an appoint on that we wanted to have them installed in the spring which would have been better for us. This request was never addressed you people were bound and determined to get them in as fast as possible and be done with us. The request was stated over and over again to your salesman and he just kept coming back with " you will love the windows so lets get them in right away" High Pressured, you think !!!! Also the reason for weekend is that we were both working at that time and did not get home until late. Your salesman even suggested Sundays. And just to be clear and for the record I certainly wouldn't say you have been trying to work with us. We received one letter from you, responded and never heard another word from you.

  • I apologize for our company for not understanding. We are trying to work with you to resolve this isue. The truth is they are custom made windows and we can not use them in any other house. We don't take back windows they are not returnable. All I can said is keep the windows until your financial situation is better and pay us when you can. We have not asked you for any money and we haven't made any demands on you. We have offered you zero percent interest and we have said that we want to work with you. Do you want us to install them and start payments in six months or twelve months. You also have to understand our point of view and try to work with us.

  • You just don't get it !!! We are financially unable to pay for the installation of your windows at this time and do not know what the future hold for us. I sure do not want to say yes in a year or what ever your requesting now because I can not predict our future. You keep saying your trying to work with us however, you keep repeating what you have previously offered which is about money we just don't have. My husband and I have talked it over many times and feel since there is no resolve that a court should hear this issue and decide what should be done.

  • One of things you have never addressed (while expounding only on your wants )
    was that your salesman repeatedly stated that your company was a very large one, that your company made windows for other large companies, that he was part owner, etc... Also we are unable to utilize our sun porch due to the fact the windows are taking up space since February. If you don not find a way to remove the windows we will deem them abandoned and dispose them as we see fit. My husband has mentioned many times that he would borrow a truck and return them to your company..... you however declined the offer.

  • Just to let you know we have checked around regarding the window's being "custom made" and were told over and over again that any windows that are being replaced l" have to be measured and it's just a business phrase that is used by companies. These companies were all well know companies !

  • It seems the company you used for the windows ( Alside Window Company ) has nothing but complaints listed for their company. Also their prices don't seem to add up ( labor unknown ) to the $10,000 for 9 windows.

  • If you would like to meet and work this out, I would like to so that we both can resolve this situation. The price of the job is $9,900 for 10 windows. The windows are custom made. I have been in this business for 34 years. Your windows are not a standard size and are not a standard installation, but a difficult installation. We can not take the windows back, but we will work with you on the price of the job or if you just want the windows and have someone else install the windows. I will be away this up coming week and I would like to meet with you the beginning of July.

We can not afford to have the windows put in by your company, why in the world do you think we would get be able to pay some other company to put them in???? My husband & I believe we should meet however our preferred arena would be court where a Judge would make a decision for us. ONCE AGAIN YOU HAVE SKIRTED THE ISSUE OF YOUR SALESMAN MISREPRESENTING YOUR COMPANY!!
