Statement of Claim
Claimant says:
"The muffler on my car was dragging and my 84 year old mother took the car in. They removed the muffler and was told she didnt need the parts. I called later that night and was told I needed a muffler from the converter back. Don quoted me a price of $785.00 plus tax and if I needed a converter would be another 500-600 more. I called my mechanic who told me $400.00. When I got it down to him we found out they cut the flex pipe and I was missing everything except half the flex pipe. They took my converters (which I was told was worth money). I called to see if they had them and within a few days they were gone. They took the whole exhaust system front to back. I called customer service and talked to Christina. At that point she told me there was nothing she could do. I faxed her a copy of the repair order showing the missing converters. They offered me $50.00. They are worth alot more. Then I talked to Terry the director. I was then told they keep parts for 15 days. There was another lie (they were gone in less than a week).. I just wanted my converters and they cut the flex pipe (which he said was still good) reimbursed since I feel they stole them from me and took advantage of an 84 year old woman who really doesn't understand. I do have a copy of the repair order that I can send you. I also have their estimate which clearly states from converter back."

  • I was lied to twice. I called back within a few days to get my converters back. I was never told the whole exhaust was broken. My 84 year old mother did not have that kind of money and was going to be taken advantage of. She would never agree to anything without talking to me because it is my car. I was offered $50.00 which was an insult because in junk yards they are worth up to $300.00 used. I have an invoice which I faxed stating I only needed from the converter back. My mother was not asked if she needed the parts back she was told she didnt need them. Also the parts are supposed to be kept for 15 days (terry the director in customer service told me) and they were disposed of in 5 days. I would like at least the money for the converter. They cut a perfectly good pipe. to get the muffler off so it couldnt have been "all broken up".

The claimant's settlement terms were rejected with the following explanation:
  • "The vehicle came in and was unsafe, the converter was dragging on the road and was all broken up, we quoted the customer a price and she agreed to the work until her daughter became involved and requested that we stop work on the vehicle because her nephew would perform at a lower price. Which they provided an estimate for almost double of what we were charging. The converter was never requested back, and we kept at our establishment for the required # of days by law, it was not until we got rid of the part we heard from Lois Gaskins demanding the part, we offered the customer above the monetary value of the part and they refused. "
