    "
This response is in regard to the claim filed by Claude Bruneau on 04/13/2022. Mr. Bruneau sold 4 tractors at a Gone Farmin' (a division of Mecum Auction, Inc.) auction in November 2021. Mr. Bruneau sold his tractors with no reserve on them. He did not have any kind of authentication documentation to confirm that they were actually John Deere equipment. In his claim, Mr. Bruneau mentioned a tractor that recently sold at our last Gone Farmin' sale (03/24-26/2022) and stated that it sold $94,000. He compared this tractor to a tractor he sold in 11/2021 which sold for $19,000. The tractor which we sold in 03/2022 was a rare model and was in pristine condition with documents of authenticity provided. Further, the condition of his tractors was nowhere comparable to the tractors that Bruneau mentioned. And, finally, the market for farm equipment is very high at this time.

Further, Mr. Bruneau claims he was "promised" $100,000 for the tractor he sold. No one on staff at Gone Farmin' promised him any amount. He was advised to put a reserve on this equipment, but he advised Paul Demchenko that he did not "believe in reserves." Putting a reserve on the tractors would be the only way in which Mr. Bruneau could expect a certain hammer price. If the reserve price was not met on a tractor, it would simply not be sold. In a gesture of good will just after the 11/2021 sale, Mr. Demchenko did refund Mr. Bruneau one-half of his seller fees which amounted to $1,950. Mr. Demchenko also waived Bruneau's entry fees which totalled $3,200. Mecum Auction, Inc. can offer Mr. Bruneau no further recourse in this matter.

It should be known that Bruneau owes a business partner of Mecum Auction, Inc.'s $6,600 from the 11/2021 sale. This partner provides carrier services and transported Bruneau's tractors to our sale site for the 11/2021 sale. His failure to pay this delinquent charge is causing issues with our business partner."

As expensive as Auction Companies are, I feel different stipulations should be in place! Both sides should "understand" the entire curriculum before any steps are taken to enact sales!!
