Statement of Claim
Claimant says:
"Every month I PAY MY MORTGAGE IN PERSON ON THE DUE DATE OR THE DAY BEFORE. EVERY MONTH I RECEIVE A STATEMENT WITH A LATE FEE OF 39.00, I BROUGHT IT TO THE ATTENTION OF THE BANK; THEY TELL ME I HAVE TO GO TO THE MORTGAGE DEPARTMENT AT A LOCATION OTHER THAN WHERE I BANK. I HAVE ALL MY RECEIPTS WITH THE DATES ON THEM. ALSO IN THE PAST I HAVE PAID SEVERAL LATE FEES SO THAT IT WOULD NOT AFFECT MY CREDIT RATING BUT NOW I'M TIRED. PLEASE HELP ME TO RESOLVE THIS MATTER."

  • Because you have proof of your payments and when they were made, you should first right a letter of complaint to the bank (at the mortgage division they specify you should talk to), include copies of your payments, including payments on late fees that should have not have been charged. You should send this certified so you can prove receipt. If this does not help alleviate the situation, you should contact the Consumer Financial Protection Bureau (federal agency) to file a complaint about wrongful late fees. You should be prepared to provide them with the same proof that you will be sending to M
