Statement of Claim
Claimant says:
"I need advice from anyone.
My wife passed away from breast cancer on June 29 2012.
She had life insurance through liberty mutual ( as far as I knew).
Now I'm not good at typing, but here goes.
3 weeks prior to my wife's passing I decided to pay a visit to the
Insurance agent at the bank where the policy was purchased
because things weren't looking good.
I wanted to make sure everything was in place just in case
things turned out for the worst. The agent pulled up the policy and
said everything looked ok. No lapse, no cancelation no nothing.
Ok...my wife passed away on a Friday early morning.
I called liberty mutual that afternoon stating that my wife passed.
I gave them the claim number ONLY to find out that the policy lapsed!!
I began to tell liberty mutual that something has to be wrong
because I just spoke with an insurance agent a few weeks ago
and it was stated that the policy still stands.
Liberty mutual stated to me that the they only received the first
initial payment 2 YEARS AGO!!!!
Which I know is impossible because at the time we purchased the insurance,
it was set up for automatic withdrawal from her account!!
AND we all had policies!!! ( son, daughter and myself).
I went back to the bank to fill the agent in on what had happened.
She pulled up the policy and once again, no lapse, no cancelation...nothing.
she also said if the polices were in danger of lapsing, she would've contacted
us because she would get notice before we would.
Now here's the catch.
A month later I received a check from liberty mutual for a little over 700 dollars.
Needless to say that's not even close to the policy value.
My thing is the way I feel it's like they were saying,
"Here Take this little check and shut up and be satisfied".
Just for the record, I am not the kind of person who tries to go after money
nor am I money hungry!! It's totally out of my character.
But I do feel that if they mailed me that check, it tells me somebody dropped the ball
and they Need to own up to it regardless if it was the agent at the bank,
or liberty mutual...somebody goofed.

What should I do???"

  • I am so sorry for your loss. It is certainly difficult enough to deal with the passing of your wife without having to worry about this situation with Liberty Mutual. In addition to contacing the department Jennifer has suggested, I would gather as much information as you can as to the policy start date, terms, payments made, etc... Discuss this with the agent that had assured you the policy was in force. Hopefully she will be able to give you the information you need to collect the money from the policy. Best of luck to you.

  • In this situation, you should immediately contact the Department of Consumer Affairs and Regulations, Insurance Division. They can potentially help you and provide guidance to you during this time. If you have the proof of payments during the term of the policy, this agency can perhaps provide you with some assistance and direction to take here. A legal consultation with an attorney may also be helpful.
