Statement of Claim
Claimant says:
"Attorney Malpractice
Attorney wrote wills for husband & wife in 1971, as life estates for both, instead of each spouse leaving their full estates to each other. Husband died in 1998, remaining spouse used same attorney to probate the will, leaving the living estate to spouse. Spouse requested the entire estate be left to 2 living children & to exclude the estate of deceased child. Attorney never went back to original will to inform spouse that if she did not dispose of the property 1/3 would go to deceased child's estate. At this time he wrote a new will for the spouse leaving her entire estate to 2 living children. Spouse died in 2009. The 2 living children went back to same attorney in 2010 to probate the will of the remaining spousel. The same attorney charged the 2 living children additional to take steps assuring the heirs of deceased would have no claim on any of the estate. This year the 2 living children try to sell their remainder of the estate (home & 30 acres of land). Title company which, this attorney is a director, declares in the deed the estate of the the 3rd deceased child is entitled to 2/12 of the proceeds of the sale. The 2 living children have no knowledge of why the will was drawn up this way. One of the children was present with this same attorney when the surviving spouse probated her spouses will & had this same attorney prepare her new will leaving, what she believed would be the entire estate to her 2 living children and excluding her deceased child's estate. At no time did this same attorney mention that she had only inherited a life estate from her spouse. In 2010 when this same attorney probated the will of the of the remaining spouse, never did he ever bring up to the 2 living children that the estate of the deceased child's would have any claims on the estate. He in fact charged them extra to assure them that the estate of the deceased child could not have claim. This attorney had 2 chances at 2 different probates to advice everyone the consequences of the original wills, but either choose not to or did not ever bother to take the time to see what he had put in the wills. With the legal fees this attorney has charged for 2 botched probates, the additional legal fees we are having to another attorney to work on this and what we having to pay the heirs of the deceased child,s estate, we are out in excess of $ 50,000.00.
