Statement of Claim
Claimant says:
"I bought a car at Kia of Coatesville on a Saturday, Jan. 12, 2013,on Monday I had to go to my bank and bring a starter check, at which time the sales paper was re-done by another finance person, who then informs me I have 2 weeks to pay $921.00, I told him I could not afford that and why was that not mentioned on Saturday and that I wanted to return the car, he states that there is no more cooling down period. He states that the deal is done and I will have to take up my problem with the bank. Also he tells me that if I do not pay the taxes my registration will be forfeited, and I discover that the insurance that they were able to get me is going to cost $417.00 a month. I have been told that this deal is legal and that there is no recourse for a deal where these people knowingly withheld information until the deal was signed. I was acting in good faith believing that Kia was doing the same. I am about to lose everything and end up with nothing, because of their underhanded practices, that I was not aware of. During the deal the only thing I was told was to sign where the x's were on the many different forms which they just kept pushing towards me."

  • If there was, in fact, misrepresentation in obtaining this contract for a sale of a vehicle, you do potentially have rights in regards to this agreement that you signed. While it is very good that the dealership has responded to this claim and encouraged you to speak to someone there, it is interesting that they are denying your claim in its entirety. Because this is a contract that is affecting you both in the long and short term, perhaps speaking to an attorney to obtain some legal advice about your rights and remedies available could be of some help to you in this situation.
