Statement of Claim
Claimant says:
"We purchased our house in September 2010.In August 2013 our basement flooded for the first time. One month later our basement flooded three more times during the Colorado "September rains". We called KB HOME emergency number in August, they refused to come and help. In September during the rain storm we tried calling them again. They could not help because they said it was the weekend and that they had no way to check our warranty. Subsequently by the 3rd flood we install a larger sump pump (Zoeller 1HP with 2" heavy duty check valve and we changed to 2" pvc pipes). This was the only way to stop further floods in our basement. We did not get anyone to come out until a week later (All water was gone by then). C. Young from KB Home came out to our home. I showed her around the basement where we found different areas of water seeping in. I showed her a whole between the floor and wall were water was coming into the basement, also show her the NEW sump pump. C.Young reply was that she needed some kind of report before she could help. We never heard from KB HOME again. Now 2 years later we are having problem again. Our sump pump can not keep up with volume of water. We called KB HOME about the problems again and asked if they could send someone out to take a look at what was wrong. We attempted to file a claim. We also though part of the problem could be the open channel behind our house because of the cut grass, trash, plastic etc... that was coming into the sump pump container. C. Young's reply was that our HOA is responsible for the channel behind our home. She explains the perimeter drain and sump are doing what they were designed to do, keep water away from the foundation. She said they installed the drain system to mitigate this water so it will not sit at the foundation. She denied the claim. We made a screen to fit over the 4 in. intake pipe into the pump container to catch all the debris coming in, we also had to seal around the pipe with a marine seal to stop rocks from falling into the container from around the pipe. We have had to set the old pump on top of the newer pump to help keep up with the water volume every time it rains or snows. We hired a sewer and water company to run a camera into the intake pipe located inside the sump pump container. This is the perimeter drain system, it shows 1 broken pipe and 1 disconnected pipe. The camera could only go 90 feet in each direction. We have no way of knowing how much damage there is to the rest of the drain system. We also found out that the drain system was never signed off on by the city building inspectors during final inspection of the home before closing back in 2010. There are no drainage plans on file with the city for our home."
